A very good copy. $200. * Second edition, published the same year as the first. This influential and fiery pamphlet is a cornerstone of early American legal reform. It serves as a scathing critique of the complex, expensive, and exclusionary legal system of the early Republic. Higgins argues that the American legal system had been corrupted by "innovations" introduced by judges and lawyers, moving away from the "Ancient Trial by Jury" toward a convoluted English Common Law model that favored the wealthy and the elite. Published by William Duane, the influential editor of the Aurora, this work played a significant role in the populist movement to dismantle the monopoly of the bar in Pennsylvania and beyond. Higgins identifies the legal profession as a modern-day Philistine oppressor, advocating for a return to arbitration and local justice to make legal recourse "cheap, speedy, and brought home to every man's door." "The work stems from Higgins's own difficulties in the chancery courts and was probably the most influential of many attacks on the legal profession in this period" (Cohen). It was an influential work in its day. As indicated by the works of such authors as Maxwell Bloomfield and Kellen R. Funk, in 1976 and 2024, it continues to attract interest. Higgins utilizes a stark biblical allegory-casting the honest American citizen as Samson and the entrenched class of lawyers and judges as the predatory Philistines-to argue that the legal system had become an aristocratic conspiracy designed to fleece the common man.
