Their decisions often affect whole societies, governments, legislation in distant countries and trigger processes od adaptation in the administration of countries, which are under the jurisdiction of such a tribunal. This book present the first part of the results of a five-year international research project, based on field research in ten European and African countries. It shows how and when International Criminal Tribunals can trigger institutional reforms even in non-democratic countries, and when and how some governments resisted the tribunals' influence. The editors and authors make an important contribution to the debates in International Relations, International Law and Political Science by showing the possibilities and limits of International Criminal Justice. Volume 1 presents the evidence from field studies in Rwanda, Kenya, Sudan, South Sudan, Libya, Kosovo, Bosnia-Herzegovina, Serbia, Croatia and Montenegro. - Content: Klaus Bachmann, Irena Ristic, Gerhard Kemp: Introduction -- The ICC as a Case of "Third Party Enforcement" -- The ICC as an Actor of Domestic Change -- Ad Hoc ICTs as Actors of Domestic Change -- Domestic Change -- Measuring the Impact of ICTs on Domestic Change -- Case Selection Criteria -- Acknowledgements -- Terminology and Political Disclaimer -- Christian Garuka: Institutional Reform in Rwanda -- An Overview of the Rwandan Conflict -- The Relations Between the International Criminal Tribunal for Rwanda and Rwanda -- Changes in Rwandan Legislation Triggered by the ICTR -- Amendment of the Penal Procedure Code -- Changes in State Agencies -- Changes in Budget Allocations -- The Efficiency of Reform -- Other Possible Causes of the Reform -- Jovana Mihajlovic Trbovc: Collateral Impact: The ICTY's Influence on Institutional Reform in Serbia -- Early Relations Between the ICTY and Serbia -- Change in Legislation Related to the ICTY -- The Law on Cooperation with the Tribunal -- The Role of EU Conditionality -- New Legislation Relevant for War Crimes Prosecution -- Change in Institutions Related to the ICTY -- The Truth and Reconciliation Commission -- Institutions in Charge of Cooperation with the ICTY -- Specialised Institutions for War Crimes Prosecution -- Procedural Novelties -- Problems in the Conduct of the Trials -- The Impact of the Scorpions Video -- Domestic Change in Serbia -- Vjeran Pavlakovic: The ICTY and Institutional Reform in Croatia -- The Croatian War of Independence and War Crimes (1991-1995) -- The ICTY and Croatia: A Troubled Relationship -- The Tudman Era ( 1996-1999) -- The Post-Tudman Era and EU conditionality (2000-2013) -- Institutional Changes and Domestic Trials -- Domestic Change in Croatia -- Aleksandra Nçdzi-Marek, Jagoda Gregulska, Irena Ristic: The ICTYs Impact on Institutional Changes in Bosnia and Herzegovina -- The Conflict in BiH -- The ICTY and BiH -- Bosnian Responses -- Institutional Changes -- The War Crimes Chamber at the Court of BiH and the Special Department for War Crimes of the Prosecutor s Office -- Legislative Change - The New Criminal Procedure Code of BiH -- The Reform of the Criminal Code of BiH -- Witness Support -- Beyond the Judiciary -- Institutional Change on the Entity Level -- Capacity Building and Knowledge Transfer -- Conclusions -- Jagoda Gregulska: The Legacy of the Judgments about the Genocide in Srebrenica -- Locating Srebrenica -- Reclaiming Srebrenica -- The ICJ as an actor of Institutional Change in Srebrenica. Buch. Zustand: Neu. Neuware - This book addresses potential avenues of criminal liability for public health crisis management in the context of the COVID-19 pandemic, under national and international criminal law, especially for causing death and bodily harm. The national case studies are geographically representative and follow a common research grid. Each national case study is prefaced by an overview of the detection and subsequent spread of the pandemic in the country concerned. The relevant legal and constitutional frameworks that governed the government and corporate conduct in the face of the pandemic are also discussed, followed by the consideration of forms of criminal liability. Government responses to the COVID-19 pandemic differed vastly in terms of both the choice of strategies adopted (herd immunity, test-and-trace, lockdown, etc) and the quality and speed of government implementation of those strategies and associated interventions. Both factors impacted the number of infections and casualties. It is therefore appropriate to consider forms of criminal liability for failure of individual members of government, including specific public authorities, to act to the best of their abilities, as timely as possible, and in accordance with expert advice.

It proceeds from values protected by international law (Part I), through substantive rules in which these values are embodied (Part II), to international and domestic institutions that enforce the law (Part III).
