Paperback. Zustand: New. This edited volume seeks to reassess the old and to analyse and develop novel approaches to the notion of proportionality in criminal matters and the new security architecture. The discourse is not limited to conventional constitutional constellations and standard problems of sentencing in traditional criminal proceedings. Rather, the book offers an interdisciplinary and cross-jurisdictional exploration of highly topical, proportionality-related issues pertinent to penal theory and legal philosophy, criminalisation policies, security and anti-terrorism strategies, alternative types of justice delivery, and supranational enforcement as well as human rights and international criminal and humanitarian law.In today's global risk society, with its numerous visible and invisible enemies of the state and the individual, balancing freedom and security has become nothing less than an attempt at untying a Gordian knot. Against this background, the proportionality of measures of crime prevention and repression is unquestionably an issue of utmost importance, which basic research and legal policy in rule-of-law based systems are urgently called to address. The timely and fascinating contributions in this book, covering jurisdictions from both the common law and the civil law as well as hybrid and international jurisdictions, will appeal to academics, researchers, policy advisers and practitioners working in the areas of national and international criminal law, comparative criminal justice/criminology and legal philosophy as well as constitutional and security law.…

Taschenbuch. Zustand: Neu. Neuware - The typical trial-oriented systems of criminal justice that are primarily based on the strict application of substantive criminal law have reached their functional and logistical limits in most parts of the modern legal world. As a result, new sanction models, less formal, administrative, and discretionary case disposals, plea bargaining arrangements, and other alternative procedural and transitional justice mechanisms have emerged at unprecedented levels in national and international legal orders affiliated both with the civil law and the common law tradition. These normative constructs and practices aim at abbreviating, simplifying, or circumventing the conventional criminal investigation and prosecution. They seek to enhance the effectiveness of conflict resolution proceedings and to shift the focus of crime control from repression to prevention. The present volume explores these alternative, informal, preventive, and transitional types of criminal justice and the legitimacy of new sanction models in the global risk society from the perspective of national and international justice and by focusing on the special regimes of anti-terrorism measures and security law. The authors of the papers are experts and internationally acclaimed scholars in this field. Their research results were presented and discussed at an international conference held on 26-27 January 2018 at Middle Temple in London, UK, which was organized by the School of Law of the Queen Mary University of London, the Max Planck Institute for Foreign and International Criminal Law (Freiburg), and the European & International Criminal Law Institute (Athens).; The typical trial-oriented systems of criminal justice that are primarily based on the strict application of substantive criminal law have reached their functional and logistical limits in most parts of the modern legal world. Taschenbuch. Zustand: Neu. Neuware - Since the entry into force of the Greek Penal Code in 1951, the basic principles governing the substantive criminal law and the provisions on the general structure of the criminal offence have remained for the most part unaltered. Changes in the general part of the Penal Code have focused mainly on the sentencing provisions, the execution of punishments, and the rules referring to juvenile offenders. The special part of the Code, however, which consists of the individual definitions of criminal offences, has been widely amended several times. Efforts have always been made to adapt the law to modern socio-ethical, political, economic, and international developments, particularly in the fields of terrorism and corruption, as well as organized, white-collar, and sexual crime. This translation covers all the revisions and amendments of the last 35 years. The present volume also includes a systematic introduction to the basic characteristics and fundamental principles of criminal law and the Penal Code of Greece. As such, it is an indispensable resource for legal professionals, comparatists, and international scholars interested in the Greek criminal justice system.…

Taschenbuch. Zustand: Neu.
