Erneut zeigt s…ich, dass die nationalen Grundlagen für eine Ahndung völkerrechtlicher Verbrechen sehr unterschiedlich sind: In China können Völkerstraftaten nur unter Anwendung des allgemeinen Strafrechts geahndet werden. Dagegen wurden in Australien und in England und Wales im Zuge der Ratifikation des Römischen Statuts neue und weitreichende Grundlagen für eine nationale Strafverfolgung derjenigen völkerrechtlichen Verbrechen geschaffen, die vom Römischen Statut erfasst werden. In den Strafgesetzbüchern von Russland und Weißrussland finden sich spezielle Strafnormen, mit denen Völkermordtaten und Kriegsverbrechen, zum Teil aber auch Verbrechen gegen die Menschlichkeit pönalisiert werden. Und in der Türkei wurden mit dem 2004 verabschiedeten neuen Strafgesetzbuch erstmals Tatbestände zur Erfassung von Völkermordtaten und Verbrechen gegen die Menschlichkeit geschaffen, während zur Ahndung von Kriegsverbrechen weiterhin ein Rückgriff auf das allgemeine Strafrecht erforderlich ist.

The studies provide an ove…rview of the wide range of approaches to the punishment of international crimes: Canada has enacted an independent Crimes Against Humanity and War Crimes Act, which penalizes acts of genocide, crimes against humanity, and war crimes. In Estonia, in contrast, these crimes are regulated directly in the Criminal Code itself. While the Estonian Criminal Code formulates the criminal offense definitions individually, the Canadian Act instead relies on references to customary international law. In Israel and the United States, crimes against Humanity can only be punished in terms of violations of ordinary criminal offenses, while acts of genocide are covered by special criminal offenses. As far as war crimes are concerned, the United States has created special criminal offenses, while in Israel war crimes can only be punished in terms of violations of the ordinary criminal law. In Greece, finally, there is no special legislation whatsoever covering international crimes.

Neuware - This publication is part of the International Max Planck Information System for Comparative Criminal Law, a project at the heart of the Institute's comparative legal research. One of its primary objectives is to develop a universal meta-structure of criminal law that can serve as the basis fo…r the organization of material, enable systematic comparisons, and further the development of an international criminal law doctrine. This meta-structure is also a prerequisite for analyzing the various approaches taken around the world to shared criminal law-related problems, identifying general legal principles, and drafting international model codes. A second goal of the project is to provide access to data from the participating legal systems in the form of country reports organized on the basis of the aforementioned universal meta-structure. Towards these ends, a pilot project was carried out to analyze, structure, and present the general part of the criminal law in twelve legal systems. The results were published in five volumes from 2008 to 2010 (in German). In the meantime, the project is being continued in English, and the number of legal systems included in the study has grown considerably - with contributions from researchers at the Max Planck Institute as well as from external research partners. This volume contains revised reports from the pilot project (France, Korea).
