Der Transitionsprozess in China entspricht eher einem politischen Richtungswechsel innerhalb einer bestehenden Grundordnung. Dieser Balanceakt zwischen politischer Kontinuität und Diskontinuität kommt auch in der Strafverfolgung zum Ausdruck. Zwischen 1976 und 1984 wurden Dutzende Personen in weiten Teilen Chinas angeklagt und verurteilt, denen strafrechtlich relevante Verfehlungen vorgeworfen wurden.
