On the one hand, the principle of non-retroactivity of laws and statutes of limitation can prevent restitution from taking place. (SI-EUR-proefschriftenreeks). - Ontrechting is een proces, waarbij mensen uit de rechtsorde worden verwijderd door hun hun rechten te ontnemen. Rechtsherstel is het restitutieproces dat een antwoord vormt op ontrechting, waarbij degenen die hun rechten kwijtraakten, in staat worden gesteld op te komen voor de teruggave van die rechten. In dit boek komen ontrechting en rechtsherstel in Nederland en Frankrijk in de periode 1940-1956 aan de orde. Beschreven wordt hoe in deze landen in het bijzonder de leden van de joodse bevolkingsgroepen in de bezettingsjaren systematisch van hun rechten werden beroofd en hoe derden daarvan profiteerden. Vervolgens wordt uitgebreid ingegaan op het proces van rechtsherstel in beide landen in de jaren van wederopbouw. Geconcludeerd wordt dat de diverse gebreken en problemen die zich in het naoorlogse restitutieproces in Nederland voordeden, grotendeels kunnen worden toegeschreven aan de wijze waarop aan het rechtsherstel reeds in Londen, onder auspiciën van de Nederlandse regering in ballingschap, juridisch vorm was gegeven. De ontwerpers van de Nederlandse rechtsherstelwetgeving hebben de rechters die in dit soort zaken moesten oordelen, uitzonderlijk veel ruimte gelaten om in elk concreet geval naar eigen inzicht te beslissen en zij hebben het rechtsherstel in zijn geheel weinig rechtsstatelijk opgezet.
