First edition of this glimpse into the personalities of the justices of the Warren Court. Quarto, original publisher's cloth, illustrated with two intimate portraits of each justice by Yousuf Karsh. Association copy, inscribed by the author on the front free endpaper to celebrated portrait photographer Yousuf Karsh, "To Yousuf Karsh with good wishes John P. Frank." With a note laid in from Frank, "Dear Yousuf - You will find an autograph in here for you from each of the Justices. Regards, JPF." Additionally signed by each Justice and inscribed to Karsh beside their portraits, in order of appearance: Earl Warren, Hugo L. Black, William O. Douglas, Tom C. Clark, John Marshall Harlan, William Brennan, Potter Stewart, Bryan R. White, and Arthur J. Goldberg. The recipient, Yousuf Karsh, is recognized as one of the leading photographers of the twentieth century. Arriving in Canada in 1924 as an Armenian refugee, Karsh eventually settled in Ottawa. Over six decades, he mastered the art of portraiture and created a unique chronicle of his time through images of celebrated legends. Some of his most notable subjects include Winston Churchill, Audrey Hepburn, Martin Luther King, Jr., John F. Kennedy, and Ernest Hemingway, among others. A celebrity in his own right, he was an elegant and charming public figure, captivating audiences with compelling stories told in images and words. Karsh sought to capture, as he put it, the âelusive moment of truth,â revealing the essential nature of his subjects as reflected in their eyes, hands, and attitudes. A unique piece of history. The Warren Court during the period from October 1967 to May 1969 represented the culmination of the Courtâs liberal constitutional revolution. This lineup presided over several landmark decisions that reinforced civil liberties and the rights of the accused. In Katz v. United States (1967), the Court expanded Fourth Amendment protections to include electronic surveillance, holding that the Constitution protects people, not just physical places. In Epperson v. Arkansas (1968), the justices struck down a state ban on teaching evolution, strengthening the Establishment Clause. Moreover, the Court advanced principles of racial equality and free expression, setting precedents that shaped American law well beyond Warrenâs retirement in 1969.

Turnbaugh. Very good. Two file holes at top margin. On Attorney General letterhead, Clark regrets at length that he cannot give the keynote address at a Youth Guidance Training Institute.

Groner who was in 1946, Chief Judge of the DC Circuit "My Dear Chief Justice," in full: "I am certainly sorry I will miss your 'silver' anniversary on the bench. Mary and I are going to Texas on the 30th for a few days and will not be here on June 1st. We want to congratulate you but think it would be more fitting to congratulate the people for having had your loyal, devoted and excellent services during those years. With every good wish, we are my dear friend, Sincerely, Tom Clark." Note: On April 22, 1946 Chief Justice Harlan Stone died, having served on the Supreme Court for 23 years. President Truman did not choose an interim Chief Justice but instead nominated Fred M. Vinson to be his Treasury Secretary. Vinson was confirmed on June 22, 1945 even though he had no previous judicial experience. So, who is Tom C. Clark writing to? This letter was written three weeks after Harlan Stone's death and four weeks prior to Fred M. Vinson's nomination. One faint diagonal crease in the upper left corner, but still in very good condition. United States Attorney General and later Associate Justice on the United States Supreme Court.

The U.S. attorney general under Truman (1945-49) was then appointed an associate justice of the U.S. Supreme Court (1949-67). Printed DS, 5pp, 9" X 6", [Washington, DC], 3 March 1974. Very good. Single vertical fold, else near fine. Headed "Supreme Court of the United States" this printed self-cover pamphlet (apparently printed shortly after its 4 May 1964 date) presents Clark's "opinion of the Court" in the case of John Coleman vs. State of Alabama. Near the top of the first page, where it states "Mr. Justice Clark delivered the opinion of the Court," Clark crosses out "Justice Clark" in black fineline, signeing bold and dating it "3/3/74." Coleman was "a Negro convicted and sentenced to death for murdering a white man" and argued "his conviction as violative of the Due Process and Equal Protection Clauses of the Fourteenth Amendment. He claims that, as a result of long-established practice in the county of his conviction, Negroes were arbitrarily and systematically excluded from sitting on the grand jury which indicted him and the petit jury which convicted him." It goes on, "Petitioner was convicted of the first degree murder of a white mechanic, the apparent motive being robbery. There were no witnesses to the killing and the evidence of guilt was circumstantial, based largely upon expert testimony given by the State;s toxicologist." Much legalese follows, but in the end "the petitioner is now entitled to have his day in court on his allegations of systematic exclusion of Negroes from the grand and petit juries sitting in his case. The judgment is therefore reversed." As a former law enforcement official, Clark's opinions often supported government prosecutorial practices, although later in his tenure he modified his stance. Whether John Coleman's new trial returned an innocent verdict we do not know. Most unusual in this form.
