The year 1889, it may be noted, marked the end of the first century in the history of the Constitution of the United States, an dthe history of the modern Constitution may accordingly be dated roughly from the appointment of Melville W. Fuller to the Chief Justiceship in 1888. For although Fuller was not, personally or philosophically, in sympathy with the new propositions of economics and government which began to come before the Supreme Court of the United States during his tenure, it was his fate to have entered the scene at the point in time when the issues created by a changing society were reaching into every phase of American life.
