In den WarenkorbPaperback. Zustand: Very Good. This work is a history of the varied fortunes of the Clan Nicolson. The study of the Hebridean clan contains details from recently discovered documents. Historical texts, myth, tradition, story and poetry are interwoven in the text. The origins of the clan can be traced back to the early 12th century, and by the 13th it was one of the most important in the Hebrides. Evidence discovered by the authors indicates that the Nicolsons allied with Edward I against Robert the Bruce in the 14th century, and that the fall in their fortunes can be linked to land disputes with the MacLeods and the MacDonalds. The emigration of the Clan Chiefship during the 19th century saw the influence of Nicolsons spread to the New World and beyond. The book has been read, but is in excellent condition. Pages are intact and not marred by notes or highlighting. The spine remains undamaged.

Taschenbuch. Zustand: Neu. Neuware - This book brings together the major writings of David Sellar (1941-2019) on the genealogies (pedigrees) claimed by some of the major clans of medieval Highland and Island Scotland, especially the descendants of their twelfth-century king Somerled. The claimed pedigrees in the medieval Gaelic 1467 manuscript and the Irish genealogies are critically analysed in relation to each other, and their historical authenticity tested against other evidence, including the Gaelic or Norse quality of their recorded names. Contemporary literary material is considered alongside later recorded traditions descending from the seanchaidh, whose work was to hand down to posterity the valorous actions, conquests, battles, skirmishes, marriages and relations of the chiefly ancestors by relating and singing them at births, baptisms, marriages, inaugurations, feasts and funerals. The family pedigrees offer crucial insights into the nature of medieval society, supporting and sometimes explaining a family's socio-political position. As an exercise in propaganda, a pedigree was susceptible to fabrication and not to be trusted uncritically.David Sellar's meticulous analysis reveals the social and political realities of medieval Celtic Scotland, making use of heraldic evidence as well as his legal expertise, in a fluent and reader-friendly style.

Taschenbuch. Zustand: Neu. Neuware - The law of presumptions has never been popular among commentators. It has attracted few scholars, and most of the few who have ventured into the subject have come away as critics rather than admirers. Certainly, there are plausible reasons for this bad reputation. Presumptions are evidently inferior to more direct forms of proof; indeed they may not be forms of proof at all. They raise difficulties of definition and classification. Some presumptions also seem quite artificial, hard to defend as reliable indicators of the truth.Despite their poor reputation, they have long been accepted and applied in practice. Legal presumptions play a part in virtually all Western legal systems. It is hard to image a workable law of proof without them, and their acceptance has been a fact of life for many centuries. Even in England, where the use of juries in the common law might seem to have excluded any need for legal presumptions, they took hold from an early date. They thus seem to be a natural candidate for comparative historical treatment. The essays in this volume seek to address this gap in scholarship. The essays do not set out directly to rehabilitate the law of presumptions. They seek rather to explore the process by which presumptions worked their way into Western law and to examine the links that have existed between legal systems. The essays embrace not only English common law and Continental systems, but also 'mixed systems' like the law of Scotland and of Southern Africa. By examining the subject from an historical point of view, they seek to help explain the acceptance and persistence of a law of presumptions in Western law.; The law of presumptions has never been popular among commentators.
