Die vorliegende Arbeit knüpft genau an diese Diskussion an und untersucht den unternehmerischen Umgang mit dem arbeitsmarktpolitischen Instrument der Arbeitnehmerüberlassung und der sich daraus ergebenden Schutzbedürftigkeit der Leiharbeitnehmer.Insgesamt ist der Einsatz von Leiharbeitnehmern für viele Unternehmen ein wichtiges arbeitsmarktpolitisches Instrument geworden, um flexibel auf Nachfragespitzen oder Auftragsflauten reagieren zu können. Das Modell Arbeitnehmerüberlassung ist für die Dynamik des Arbeitsmarktes von wesentlicher Bedeutung geworden, denn es bietet vor allem arbeitslosen Bürgern eine Chance auf ein sozial abgesichertes Beschäftigungsverhältnis: Auch eine Arbeitnehmerüberlassung verschafft in der Regel volle sozialversicherungspflichtige Beschäftigungsverhältnisse und gibt Perspektiven.
