Zustand: Good+. 7th ed. revised and corrected. xli+341, 1829 dated sig.top t.p., occ.intermittent foxing/spotting, v.occ. sm.early ink annotations/ marginalia/ corrections, and the odd minor ink smudge (the t.p. sig. and some marginalia are cropped, suggesting binding not original). Black texture cloth covers clean but incipient cloth split down fr.joint and bottom 3 cms sp.frayed & chipped, with sl. loss along back joint. Burlamaqui (1694-1748) was a Swiss jurist, this is his major work and appeared in French in 1747, Nugent's translation being issued the following year. This may well be a reprint of the 7th ed. rather than the 7th ed. itself, as it seems unlikely Nugent was still working on it 71 years later! Given Burlamaqui died the year after it was first published, it is also unclear to me why new editions would be revised or continue to need correction, unless Nugent added new material (but there is no indication of this and the footnotes are quite minimal and apparently original except when related to translation points). The 5th ed. was 1791.…

"Burlamaqui formulated the principles of popular sovereignty, of delegated power, of a constitution as a fundamental law, of a personal and functional separation of powers into three independent departments. and finally, he provided for an institutional guardian of the fundamental law" (Harvey). Burlamaqui's other great achievement was to put Pufendorf's theories into systematic form. Marvin stated a general opinion when he observed that "his works are deservedly held in high esteem."
