Não resta dúvida que as lesões aos interesses juridicamente merecedores de tutela adquirem contorno peculiar na medida em que a injustiça alcança não só o dano em si, mas reverbera em uma dimensão coletiva de discriminação e estigma. As ofensas às chamadas minorias sexuais não podem restar incólumes, pois tais grupos vulnerabilizados necessitam, em um Estado Democrático de Direito, de especial atenção sob pena de padecerem de uma realidade que os aparte plenamente de uma vida digna, muitas vezes flertando com uma realidade de segregação e estigma tamanha que os priva do exercício pleno de sua cidadania inclusiva. Trazer a público uma obra com 20 artigos tratando da relação existente entre responsabilidade civil e os elementos da sexualidade (sexo, gênero, orientação sexual e identidade de gênero) é vital não só em razão do conteúdo valioso dos artigos que a compõe, mas também por conferir visibilidade ao tema que muito sofre com as alegações de ausência de legitimidade ante a existência de uma igualdade formal (mas longe de se consolidar como material e substancial), bem como pelo desprezo das pautas das minorias identitárias, tratadas por muitos de forma jocosa e marginalizada".
