El Derecho, en lo que concierne a su posición empírica, pertenece indudablemente al reino de las instituciones ôsocialesö. Únicamente si existe un tipo de valor específicamente ôsocialö, junto al ôético-individualö, la indiscutida significación empírico-social del Derecho puede obtener, también, un correlato en la esfera del valor absoluto. Solo en este caso, no estaría el Derecho simple-mente en una relación instrumental con un tipo de valor individual-ético, extraño a su propia estructura social. Recién, entonces, se puede comprender fundamentalmente que el Derecho como fenómeno ôsocialö mismo, puede encontrarse dentro de la esfera de lo valioso. Por lo tanto, si existen fines sociales últimos, cuyo medio es el Derecho, únicamente entonces.
