First editions of three pleadings in the legal case of Joseph Knight, an enslaved West African brought to Scotland and demanding his freedom under Scottish law. The case was significant as a test of the Mansfield judgement, as fomenting a public discussion about the morality and legality of slavery, and as a reference for the growing anti-slavery movement. Knight was born in west Africa around 1753 and sold to the English slaver Captain Knight (after whom he was named). Captain Knight brought him to Jamaica and sold him to John Wedderburn, probably in 1766. Wedderburn brought Joseph Knight to his Scottish homeland in 1768, as an enslaved domestic servant. In 1772, Knight claimed freedom following Lord Mansfield's judgement in the case of James Somerset that slavery was not instituted in English law - Knight held that the logic of the ruling was equally valid under Scottish law. He left for Dundee, whereupon Wedderburn received a warrant for Knight's arrest. The Perthshire judges (all closely connected with Wedderburn and with interests in slavery) found against Knight. Knight then raised it to the sheriff court at Perth, which found in Knight's favour, and that the slave law in Jamaica did not apply in Scotland. The case advanced to the court of session, resulting in ongoing litigation until 1778. The court ultimately sided, despite internal disagreement between the judges, with the decision that Knight could not be enslaved in Britain, and found that Knight could not be sent to Jamaica against his will. The pleadings in the case were printed, as was usual for major legal cases in Scotland. "The printed pleadings were learned and far-ranging, those for Knight stressing the iniquities of the slave trade and challenging the traditional legal and economic arguments in favour of slavery" (ODNB). Significantly, the pleadings do not limit themselves to the specific question of Scottish law on the subject, but consider the question of the transatlantic slave trade itself, its history, and its impact on African society. The three pleadings here present, two in favour of Knight, one opposed, are powerful exemplars of the arguments both for and against slavery at the time. The first pleading is by Allan Maconochie, one of Knight's counsel. Maconochie rejects various arguments for the legitimacy of enslavement - through captivity in war (as argued by Greek and Roman writers), through "voluntary" agreement by the enslaved person, and through birth to enslaved parents. He charts the history of West African slavery, the role of European traders in exacerbating demand and thereby stimulating the wars and intensifying the punishments which lead to enslavement, and the destructive effects of the trade on African societies. He notes the brutality of slavery in the West Indies and the lack of rights of enslaved persons there. He argues for the inapplicability of Jamaican law to Scotland, and rejects claims that Scottish villenage law can be invoked. The second pleading is by James Ferguson, John Wedderburn's initial counsel. The pleading, along with others presented by Wedderburn's lawyers, has been called "one of the most sustained justifications of slavery in any of the polemics of the times" (Rothschild, p. 94). Ferguson argues - in direct opposition to Maconochie - that slavery is not contrary to the laws of nature, and that it can be legitimately created by captivity and birth. He argues against cruel conditions and resulting high death rates on slave ships and plantations, as the pecuniary interest of the slavers and owners incentivizes them to maintain the health of their slaves. Slavery is essential in the West Indies, and in turn the West Indies are essential to the prosperity of Britain. Ferguson then defends the enslavement of Knight with reference to Scottish law and villenage. The third pleading is by John Maclaurin, in favour of Knight. Maclaurin had in a former case been employed to plead for a master against a slave, but here pleaded against slavery. Notably, he enlisted James Boswell as an assistant, who in turn approached Samuel Johnson for a legal brief. In his pleading, Maclaurin presents slavery in the West Indies as untrammelled ownership by the planters. Against the arguments that plantation owners have a financial incentive to treat slaves well, he holds that their interest is instead to work them as hard as possible. He upholds that Jamaican slave law cannot transcend its own borders and apply in Scotland, and like Maconochie argues that Scottish law precludes it. He rejects the innate inferiority of the Africans, with apparent intellectual differences compared to Europeans instead a consequence of a lack of education. In a particularly arresting passage (p. 19), Maclaurin asserts that though "Europe and America have long conspired to hold Africa in chains", a revolt may come which instead subjugates the whites to a "Code Blanc. founded on the principles of retaliation". All three works are rare - ESTC locates a single copy of the first two works, in the Advocates Library, and for the third work locates two copies, in the Advocates and Senate House libraries respectively. Library Hub adds another copy of the first work in the University of Dundee, and copies of the second in Edinburgh and Senate House.
