In den WarenkorbISBN-13: 9781584772941; ISBN-10: 1584772948. Beale, Joseph Henry. Bartolus on the Conflict of Laws. Translated into English by Joseph Henry Beale. Originally published: Cambridge: Harvard University Press, 1914. 86 pp. Reprinted 2003 by The Lawbook Exchange, Ltd. ISBN-13: 9781584772941; ISBN-10: 1584772948. Hardcover. New. $39.9…5 * This is a notably lucid translation of the sections concerning the conflict of laws in Bartolus's Super Primam et Secundam Partem Codicis Commentaria, a commentary on the first two books of Justinian's Code and its glosses that circulated widely in manuscript and was first printed in 1471. Taken together, these sections comprise the first comprehensive statement on the subject. One of the great medieval commentators, Bartolus di Sassoferrato [1313-1357] was a professor of law at the University of Perugia. His authority as an expositor of Roman law was immense, and it endured for centuries. A practical lawyer, Bartolus attempted to derive principles suitable to his time from the accumulated layers of local, feudal and Roman law. Joseph Henry Beale [1861-1943] was a professor at Harvard Law School and served as the first dean of the University of Chicago Law School. An influential authority on the conflict of laws, corporations and criminal law, he also published important work in legal history and bibliography. He was a distinguished classicist while an undergraduate at Harvard. "Mr. Beale in this translation presents a clear statement of these principles as laid down by Bartolus and the modern lawyer should have no difficulty in understanding the true meaning. (.) The book should prove of practical assistance to those engaged in tracing the historical development of the law, and should be of interest, at least from an historical point of view, to every lawyer." --E.W.M., 63 University of Pennsylvania Law Review 583 (1915).

Smyth sewn tan cloth with green an…d black gilt stamped spine labels. New. $295. * A reprint of the monumental first edition of Joseph Henry Beale's definitive work, a masterpiece that stands alongside Samuel Williston's Contracts and Wigmore on Evidence as one of the undisputed pillars of twentieth-century American jurisprudence. As a founding father of modern conflict of laws and a dominant intellectual force at Harvard Law School, Beale dedicated his life to systematizing how courts resolve legal disputes spanning multiple jurisdictions. His work was so highly regarded by contemporaries that Legal Realist Jerome Frank remarked in Law and the Modern Mind that this treatise might well be the finest legal work produced in his lifetime. The historical importance of this three-volume set is deeply intertwined with the early history of the American Law Institute (ALI). Originally, the ALI planned to publish official, comprehensive treatises to accompany the "black-letter" text of its Restatements. When the Institute abruptly abandoned that plan, Beale independently completed his own text. The result is an invaluable, unmatched legal monument. Writing a contemporary review in the Columbia Law Review (Vol. 35, 1935), legal scholar Walter Wheeler Cook emphasized that the treatise serves three vital functions: it contains the most exhaustive collection of American conflict of laws cases ever assembled; it delivers the matured conclusions of the nation's preeminent authority on the subject; and it provides the indispensable commentary required to interpret and understand the authority behind the Restatement's specific sections. This is an essential work for legal historians and scholars of American jurisprudence.
