This treatise was first published in London in 1834 by English barrister John William Smith and went through several English and American editions and issues. It became a standard reference work on commercial law in both England and America and saw numerous editions throughout the 19th and early 20th centuries. The American editors were: James P. Holcombe, a law professor at the University of Virginia and a legal author, Holcombe was a Confederate politician and diplomat during the American Civil War and William Y. Gholson, a lawyer and judge who practiced law in Ohio and later served on the Ohio Supreme Court. This 1861 edition, was published in New York during the Civil War, and was "greatly enlarged and revised" to reflect American legal practices, incorporating significant annotations to adapt the English source material for the U.S. legal system. The editors' affiliations with different sides of the war (Holcombe, a Confederate; Gholson, an anti-slavery advocate) highlight the complex political climate in which the work was published.
