Beattie "the foundation text of the ideology of jury independence and of the jury as the bulwark of English liberty," this important work was first published in 1680 with the title Grand Juryman's Oath and Office Explained. A staunch Whig, Hawles [1645-1716] wrote The Englishman's Right to outline the rights, duties and proper behavior of a juryman and to show him how he was an agent against tyranny. Immediately successful among Whigs and others who saw themselves as defenders of English liberties, it was received with great enthusiasm in America, where it was reprinted several times well into the nineteenth century. According to Cohen's Bibliography of Early American Law, it was probably the first English law book reprinted in the American colonies (1481).

This is seemingly the second edition of a work first published in 1680 ( 4to. ), though this is not noted on the title page. ' J.K.' in his [ Address ] to t…he Bookseller suggests that the earlier edition was written anonymously and then continues - ' I cannot do better than in desiring you to reprint this excellent little treatise, in which the original Design, Duty and Power of Jurors are clearly explained . . ' . Hawles was a committed Whig supporter, his idea in writing this piece was to inform jurymen of their modus operandi and behaviour when sitting on a jury. The pamphlet was received with much approbation by the Whigs in Great Britain, in America it was similarly well received and was reprinted a number of times. ESTC T106583.

First published in London in 1680 during the turmoil of the Exclusion Crisis, The Englishman's Right was written by Sir John Hawles, a prominent Whig barrister who later served as Solicitor General under William III. Framed as a dialogue between a seasoned barrister and a conscientious juryman, Hawles outlines the historical origins, constitutional authority, and solemn duties of juries under English common law. Writing in the immediate wake of Bushell's Case (1670), which firmly established that judges could not fine or imprison jurors for returning a verdict contrary to the court's direction, Hawles championed the jury as an indispensable safeguard against judicial bias and royal despotism. Prior to this landmark case, courts routinely coerced juries by withholding food and water until a "guilty" verdict was delivered. Hawles popularized the ruling that a jury could not be punished for its verdict, effectively laying the groundwork for the modern doctrine of jury nullification. While initially written to counter royal absolutism in Great Britain, this specific 1771 edition was published at a critical tipping point in the American colonies. Possibly a response to the recent passage of the Alien and Sedition Acts, it has an interesting preface by the bookseller, Alexander Brodie: "But lest the title 'The Englishman's Right' should give offence to any, it is proper to observe that the Charter of the Liberties of England is a grant from their kings obtained by force.let it be remembered, that Judges are appointed to interpret the Laws faithful but Juries were instituted to watch and restrain Judges." Written by a staunch Whig, The Englishman's Right was published in the immediate wake of Bushel's Case (1670) to establish that juries have a right to judge both the fact and the law according to their conscience, free from judicial punishment. It served as a powerful bulwark against Crown tyranny and achieved immediate success in England. The text went on to exert a massive influence on colonial American legal thought. Famously reprinted by Benjamin Edes in Boston in 1772 to protest British authority, Hawles' arguments heavily informed the framework of the Sixth Amendment to the U.S. Constitution. The contemporary margin note in this copy is of particular association interest; by actively disputing a reference to Coke on Littleton, the absolute authority on English common law at the time, it demonstrates this specific copy was utilized as a working legal reference tool during the height of these 17th or 18th-century constitutional debates.
