Originally published in London in 1680 under the title Grand Juryman's Oath and Office Explained, the text was composed by staunch Whig barrister (and later Solicitor General) Sir John Hawles. Written in the turbulent shadow of Bushell's Case (1670), Hawles sought to widely popularize the revolutionary ruling that a jury could not be coerced, fined, or starved into delivering a verdict dictated by a magistrate. Legal historian J.M. Beattie famously deemed the work "the foundation text of the ideology of jury independence and of the jury as the bulwark of English liberty," laying the structural groundwork for what is recognized today as jury nullification. While previously reprinted in colonial Boston (1693, 1772), this 1798 Philadelphia issue carries profound political urgency. Released during the height of the Federalist-Republican divide and explicitly responding to the authoritarian reach of the Alien and Sedition Acts, the bookseller Alexander Brodie appended a bold preface noting that "Judges are appointed to interpret the Laws. but Juries were instituted to watch and restrain Judges." It remains a landmark defense of civil liberties and democratic constraints on judicial tyranny. This is seemingly the second edition of a work first published in 1680 ( 4to. ), though this is not noted on the title page. ' J.K.' in his [ Address ] to the Bookseller suggests that the earlier edition was written anonymously and then continues - ' I cannot do better than in desiring you to reprint this excellent little treatise, in which the original Design, Duty and Power of Jurors are clearly explained . . ' . Hawles was a committed Whig supporter, his idea in writing this piece was to inform jurymen of their modus operandi and behaviour when sitting on a jury.
