Das Betriebsverfassungsgesetz (BetrVG) knüpft dabei an eine starre und zentral-hierarchische Organisationsstruktur an. Arbeitgeber und Betriebsrat können u.a. aufgrund komplexer Unternehmens- und Konzernstrukturen, divergierender Interessen verschiedener Belegschaftsgruppen oder des möglichen Erreichens von Schwellenwerten ein Interesse daran haben, die gesetzliche Betriebsstruktur (1, 4 BetrVG) anzupassen. Um die Passform der gesetzlichen Betriebsstruktur zu verändern, erlaubt das BetrVG gewillkürte Betriebsstrukturen vor allem durch Tarifvertrag (»Strukturtarifvertrag«), Betriebsvereinbarung (»Strukturbetriebsvereinbarung«) und vereinzelt durch Urabstimmung der Belegschaft (3 BetrVG) sowie die Verselbständigung von Betriebsteilen (4 Abs. 1 BetrVG). Die Betriebsparteien können einvernehmlich die Betriebsstruktur nur durch Strukturbetriebsvereinbarungen nach3 Abs. 2 BetrVG mit normativer Wirkung anpassen. Dieser betriebsautonomen Gestaltungsmöglichkeit der Betriebsratsstruktur, ihrer Defizite und möglichen Reformen geht die Arbeit nach.
