In den WarenkorbZustand: Good. First Edition. Small 4to. 44 pp. Original printed wrappers (chipped, spine partially defective). The complex and protracted litigation over the San Francisco estate of one of the richest men in America, mining tycoon James Graham Fair, dragged on for many years after his death in 1894. Born in Ireland in 1831, Fai…r and his impoverished father came to the U.S. in 1843. James went to California in 1850 to labor as a lowly prospector; he soon turned his attention to Nevada. After working as a superintendent and engineer at various mining sites, he formed a partnership with three men, two of whom were born in Ireland and one was the son of Irish immigrants. Together they made millions in silver mining in the Comstock Lode, one of the largest silver deposits ever found; indeed, in just six years the Comstock Lode produced more than $100 million worth of silver bullion ($3.5 billion in today's currency). By 1875 the four "Silver Kings" had become fantastically wealthy. Fair invested shrewdly in the South Pacific Coast Railroad and in real estate. But money led to a dissolute life of affairs and alcohol. In 1883 his wife filed for divorce which was uncontested; she received the family mansion and nearly $5,000,000 in cash (at that time the divorce settlement on record), while also gaining custody of their two daughters from whom Fair had become estranged. His two sons also caused him much unhappiness. He campaigned successfully for a seat in the U.S. Senate in 1881, but following his defeat in 1886 he lived the rest of his life alone in a hotel. At his death Fair's wealth was estimated at $50,000,000 -- an almost unbelievable sum in those days. Our volume is S.F. 2871 (March 19, 1902) and concerns the famous litigation of the $18,000,000 worth of real property in Fair's trust and estate. Here the appellants in the case are the counsel of said trust, which was created by Fair's will for his children during their lives, followed upon their death by a trust to others. The trustees were empowered "to sell any property," real or personal, and to invest the proceeds, and to purchase other property, or to apply the proceeds of sales to the improvement of other property, and for any other of the purposes declared in the will, and to pay to the children mouthly "the net income." The court declared void the entire trust scheme as to the realty. An interesting aspect of the case involves the forensic accounting undertaken by one of the appellant's laywers, George E. Crothers, who had personal charge of the forgery branch of the litigation; Crothers won a notable victory in the proof of a forgery by original mathematical lines of deduction based upon consecutively numbered checks. (SOURCE: L.F. Byington, History of San Francisco, 1931, vol. 2, pp. 64-76). The full text of Fair's Last Will and Testament, dated 1894, appears at end. Scarce: two copies in OCLC FirstSearch (Berkeley and California Historical). Not in the Library of Congress. Not in Rare Book Hub.

In den WarenkorbHardcover. Wide small 8vo. Full calf boards with black cloth tape spine, front board gilt lettering. Unpaginated. All edges gilt. Ivory watered silk endpapers. Very good. Boards are edgeworn and a bit rubbed though gilt lettering is bold; internally tight and fine. Senator William B. Allison of Iowa was a Congressional mainstay…who after eight years as representative served thirty-five years in the Senate, celebrating a quarter century as senator in 1898. To honor the occasion, Allison was presented this autograph book, with first leaf penned "To / Senator Allison, / Compliments of / Dell Sumner. / 55th Congress." Facing recto leaf is signed huge and bold by President McKinley and next recto by the vice president ("Yours very truly / Garret A. Hobart / Vice President, / Feb. 21, 1898"). Each of the forty-five recto leaves that follow is signed by two senators from each state, running alphabetically from Alabama through Wyoming. All sign in ink and most huge and bold, many following their signature with the name of their state and a few add a date. Among the notables signing are all four of the "Big Four," the power brokers who exercised enormous influence and power on legislative issues: Orville H. Platt of Connecticut, Nelson W. Aldrich of Rhode Island, John C. Spooner of Wisconsin and William B. Allison himself. (Presumably a small number of these keepsake albums were signed in advance.) Also present are Charles W. Fairbanks of Indiana, who would become Theodore Roosevelt's second vice president, Frank J. Cannon of Utah (first U.S. Senator from that State) and Henry Cabot Lodge of Massachusetts, the well-known statesman and historian. A total of 92 senators sign after the president and vice president. (Mississippi shows three senators since Edward C. Walthall and Hernando D. Money sign, but Walthall died on April 21, 1898 and his replacement William V. Sullivan also signs; Vermont shows three senators since Justin S. Morrill signs, but he died on December 28, 1898 and his replacement Jonathan Ross signs, as does Redfield Proctor.) 15 blank leaves close out the volume. This remarkable album is accompanied by Allison's personal briefcase, a full calf portfolio (12½" X 10") whose flap closes with a metal catch (locked), below which is stamped in large gilt letters, "HON. WILLIAM B. ALLISON, / UNITED STATES SENATE." Interesting and displayable, although in condition fair only, the leather heavily cracked and chipped. Also present is a fine first edition of "William Boyd Allison (Late a Senator from Iowa): Memorial Addresses," published by the Government Printing Office in 1909. Both album and portfolio hail from the library of William B. Allison (1829-1908), the powerful Iowa Republican who, as U.S. senator from that state (1873-1908), was one of the "big four" who controlled the Senate; as chairman of the Senate Appropriations Committee for most of those years, he championed tariff legislation and co-authored the Bland-Allison Act of 1878; as member of the Senate Finance Committee he was often courted by U.S. presidents to hold cabinet positions. Early 20th century bookplate on front pastedown notes "Carnegie-Stout Free Library, / Dubuque, Iowa," with smaller plate beneath recording "Gift of Hon. W.B. Allison." Until deaccessioned this was part of Allison's non-circulating collection at his hometown public library across the street from his Dubuque residence. Signed.
