Frederick Bernays "Fritz" Wiener (June 1, 1906 - October 1, 1996) was an American jurist specializing in military justice and constitutional law who became famous for the 1957 case of Reid v. Covert, which represents the only time a lawyer lost in the Supreme Court of the United States but prevailed on rehearing. That case was particularly notable in that it established that "no agreement with a foreign nation [i.e., no treaty] can confer power on the Congress, or on any other branch of Government, which is free from the restraints of the Constitution." He is also noted for arguing for the victorious appellants in the racial discrimination case Moose Lodge No. 107 v. Irvis, 407 U.S. 163 (1972). Wiener graduated cum laude from Brown University in 1927, and magna cum laude from Harvard Law School, where he was note editor for the Harvard Law Review, in 1930. During World War II, he served in the Judge Advocate General's Corps, retiring from the United States Army in 1966 with the rank of colonel. Working for the Solicitor General's Office and later in private practice, he often argued before the U.S. Supreme Court. In 1974, he was awarded the U.S. Army's Outstanding Civilian Service Medal. Wiener was called no less than seven times to testify before Congress on matters pertaining to military law. From a published review found on-line by Associate Justice of the United States Supreme Court William O. Douglas: This is a unique and extremely valuable book touching on an important area of military law. Its author, our foremost military law authority, was an advocate in some of our leading Supreme Court decisions dealing with the problem.' His credentials do not stem from his briefs in those cases alone. Rather, the book is a pioneer work, truly revealing newly discovered chronicles dating back to the first British Mutiny Act of 1689. Those who have worked in this field will be amazed by the nature, quality, and depth of the new materials now presented. They were overlooked by Holdsworth, Fortescue, and Clode. Mr. Wiener found them in scattered sources, and dirtied his hands working through them. One source was the headquarters order books of the British Army in North America, preserved at the University of Michigan in Ann Arbor. Another was the records of trials recorded in the War Office court-martial books in the Public Record Office in London. The leads supplied there led into correspondence files and secondary sources. The totality of the new finds corroborates the Supreme Court decision that in time of peace the military have no jurisdiction to try civilians. Three heads of jurisdiction emerge over the two and a half centuries of British and American law examined in the volume: (1) the law governing the armed forces; (2) military government or the law of belligerent occupation; and (3) martial law or the use of military means to preserve the domestic peace.
