Originally published: New York: G.P. Putnam's Sons, 1915. x, 234 pp. Reprinted 2010 by The Lawbook Exchange, Ltd. ISBN-13: 9781616190675; ISBN-10: 1616190671. Paperback. New. $18.95 * In this work Professor Colby has gathered, annotated and arranged into a sequential history of English law numerous essays by Maitland and Montague. "These articles supplied what long had been needed for general readers and for law students-a brief but comprehensive, accurate but untechnical account of the origin and growth of English law. . . . this series of articles now forms the best available introduction to English legal history." James F. Colby, iii. Widely considered the father of legal history, Frederic William Maitland [1850-1906] was an English jurist and historian best known for the standard The History of English Law Before the Time of Edward I, 2 vols. (1895), written with Sir Frederick Pollock. He was educated at Eton and Cambridge and studied at Lincoln's Inn, London. Maitland was called to the bar in 1876, and practiced until 1884 when he became a reader in English law (1884) and professor (1888) at Cambridge. He founded the Selden Society in 1887. Hailed for his original outlook on history, his works profoundly influenced legal scholarship. An extraordinarily productive career was shortened by his death from tuberculosis at age 45. Francis C. Montague [1858-1935] was a Professor of History at University College, London and Lecturer in Modern History, Oriel College, Oxford. He was also the author of The History of England from the Accession of James I. to the Restoration (1907) and The Elements of English Constitutional History from the Earliest Times to the Present Day (1910). James F. Colby [1850-1939] taught international law at Yale Law School from 1883 until 1885. He later taught history and political economics at Dartmouth College, and was Parker Professor of Law and Political Science at Dartmouth College from 1885-1916 and lectured in jurisprudence and international law at Boston University Law School from 1905-1922.

Taschenbuch. Zustand: Neu. Druck auf Anfrage Neuware - Printed after ordering - The forms of action are a part of the structure upon which rests the whole common law of England and, though we may have buried them, they still, as Maitland says, rule us from their graves. The following extract is taken from the editors' preface: 'The evasion of the burden of archaic procedure and of such barbaric tests of truth as battle, ordeal and wager of law, by the development of new forms and new law out of criminal or quasi criminal procedure and the inquest of neighbour-witnesses has never been described with this truth and clearness. He makes plain a great chapter of legal history which the learners and even the lawyers of today have almost abandoned in despair. The text of the chief writs is given after the lectures .'.

Taschenbuch. Zustand: Neu. Druck auf Anfrage Neuware - Printed after ordering - As the Downing Professor of the Laws of England, F. W. Maitland lectured on equity at Cambridge for 18 years, ending in 1906. The lectures were first published in 1909 under the editorship of A. H. Chaytor and W. J. Whittaker. They were reprinted seven times before being published in 1936 in a second edition edited by J. Brunyate, who added some notes to Maitland's lectures. This edition is replicated here. Equity is an important aspect of English law. Its rules grew up to supplement Common Law and largely concern such matters as wills and trusts.

Taschenbuch. Zustand: Neu. Druck auf Anfrage Neuware - Printed after ordering - 'Constitutional history should, to my mind, be a history not of parties but of institutions, not of struggles but of results .' F. W. Maitland's remarkable course of lectures provides the basic framework of English constitutional history in a brief, but original, scholarly and very readable form. His method is to take five crucial periods and to present in each a panoramic view of the processes of law and government; his attention is always fixed on the constitution as a growing fabric, as something devised and employed by live human beings. And in this work, as in all he subsequently wrote, Maitland shows a rare combination of high speculative power with exact knowledge of detail.
