This is the first edition to included the account by Judge Gorham of the attempted assassination of Field by former Associate on the California Supreme Court David Terry. With paper inscribed "Compliments of Mr. Justice Field" pasted to the title page (note, we do not believe that this is Fields' signature -- probably the hand of a clerk or secretary). ~~Field was appointed by President Lincoln to the Supreme Court in 1863; he had gone to California during the Gold Rush years and while there his legal career took off. He had a pretty wild time in California, and this account depicts his legal life and adventures with vivacity and color. Pretty amazing stuff. (Howes F117; Graff 1316; Cowan 209). Very Good binding.

Provenance: with the bookplate of James S. Copley on the front paste-down, his sale, Sotheby's New York "Magnificent American, Historical Documents", 10th May 2011, lot 1059. First and only edition. For more than 30 years Field served as associate justice of the U.S. Supreme Court, and his vision of entrepreneurial liberty dominated constitutional doctrine until 1937. He arrived in California in 1849, drawn to the Gold Rush. "The journey took him by sea to Panama, where he crossed the isthmus on foot and small boat. He then made his way up the Pacific Coast by steamer, arriving in San Francisco on 28 December 1849. Field survived his first days there by selling newspapers he had brought from the East; however, he was soon able to open a law office with money he obtained from a fellow Massachusetts native who owed a debt to his brother. His law practice in San Francisco lasted less than one month. He soon moved on a settlement that became the city of Marysville just after his arrival. Field was elected to the office of alcalde, a position derived from Mexican tradition that combined the functions of judge and mayor. He remained alcalde until June 1850, when the American style of government was installed in California. On 7 October 1850, Field was elected to the California State Assembly, where he served a one-year term and then returned to private practice in Marysville. Active in Democratic party politics, he unsuccessfully sought election to the U.S. Senate in 1857. The effort raised his stature and brought him allies in the party. In September of that same year, he won election to the California Supreme Court as associate justice; he became chief justice in 1858 and served in that capacity until 1863" (Paul Kens for ANB). Born in Connecticut, Stephen Johnson Field was practicing law in New York when word of the Gold Rush arrived. He sailed to California in 1849, crossing Panama at Chagres. He soon became a leader of the California bar, going on to sit on both the State Supreme Court and the United States Supreme Court. His book focuses on his first years in California, centering on his experience as practicing attorney and the first alcalde for the mining town of Marysville, 1850-57. In the second section, he relates anecdotes of his later career as justice, first of the California Supreme Court, then of the U.S. Supreme Court. Very scarce first edition, in original binding (later reissued with additional material). A very good copy. Cowan, p. 208; Howes F-117.
