An appeal to the House of Lords in the case of the Earl of Aboyne against the Earl of Aberdeen, over the behavi…or of the arbiter John Innes, factor to the Earl of Fife. The two Earls had seen frequent border scuffles, including the construction and destruction of livestock shelters, in their estates in Cromar, Aberdeenshire, and consequently employed an arbiter to settle disputes as they arose. Aboyne complains of the arbiter?s decisions and Aberdeen responds in kind; this copy bears an annotation of the decision in favour of the latter. A substantial transumpt (a formal copy or transcript of a document made for parties to a litigation), totalling around 18,000 words, covering a dispute over ownership of land in Aberdeen, between…Magnus Mowat and William Cruickshank, an Aberdeen merchant. The document provides information about the history of ownership of the relevant land, mentioning other parties including the University of Aberdeen, and the Leslie and Bruce families. It was produced on behalf of Alexander Thomson, town clerk of Aberdeen, who signs the foot of each page, and who held that position between 1694 and 1713. The printed informations provided for later Scottish legal cases are generally rare, and surviving manuscript versions like this even scarcer. Not in ESTC.

Published in either 1742 or 1743, but certainly not before 11 August 1742, the date at the end of the Schedule, folio 33. Presumably published soon after 26 October 1742, the date when Lord Baltimore made Sir Dudley Rider his attorney general, who is named on the title-page, as a party to the proceedings. The bitter dispute, which this legal brief reports, between the influential proprietary Penn and Calvert families, began when William Penn received his grant for Pennsylvania on 4 March 1681, and raged uninterrupted, and including the occasional armed conflict, for nearly 90 years before the Mason-Dixon line was firmly established and the boundary set for posterity. Both families claimed land that included Philadelphia, with the Penns claiming the 'lower' counties that make up present-day Delaware for Pennsylvania. Since 1632 the Calvert family (the Lords Baltimore) had been the hereditary proprietors of Maryland, with near absolute powers granted to them by Charles I through the Maryland charter. However, their "proprietorship was lost following the revolution of 1688 in view of the Calverts' Roman Catholicism and alleged sympathy for James II. Charles's father spent much of his life shedding his Stuart ties in the hope of regaining the proprietorship. His renunciation of Roman Catholicism in 1713 and confirmation in the Church of England removed the final obstacle. On the death of Charles's grandfather Charles Calvert, third Baron Baltimore, on 21 February 1715, the proprietorship was returned to the family. The success of Charles's father was short-lived, however, as he died less than two months later. Aged fifteen, Charles Calvert now inherited the barony and the proprietorship. Upon coming of age Baltimore made it clear that he had no intention of being an idle proprietor. Facing him, however, was a monumental task of reasserting his authority over a colony that had grown steadily independent in the Calverts' absence. The lower house of the Maryland assembly had steadily eroded the authority of the executive, and its members would not be brought to heal without a struggle. Baltimore's first action was to reassert the physical presence of the Calverts by sending family members to the colony as governors" (Troy O. Bickham for DNB online). The land granted to Lord Baltimore in Maryland gave him the territory from latitude 40 degrees north southward to the south bank of the Potomac River and eastward.
