Enerzijds normeert het straf(proces)recht de relatie tussen overheid en burger, anderzijds regelt het de interne betrekkingen tussen overheidsfunctionarissen. In dit geheel van externe en interne relaties worden verantwoordelijkheden en gezagsaanspraken over personen en instanties gedistribueerd. Al enige decennia zijn deze relaties van gezag en verantwoordelijkheid op verschillende niveaus aan soms subtiele, soms ingrijpende verschuivingen onderhevig.
