Pliny Merrick: Report of the Joint Special Committee of the Senate and House of Representatives, Giving the Petitioners Leave to Withdraw Their Petition. Boston: George C. Rand & Co., 1849. 74 pp. Sewn pink printed wrappers. Moderately edgeworn and soiled. Internally clean. A good copy. $250. * a collection of the official proceedings from the Massachusetts Senate and House of Representatives concerning a petition filed in 1849 by George R.M. Withington and others to have James G. Carter removed from his position as a Justice of the Peace for Worcester County. The volume documents the entire case, including: The opening arguments presented by the Honorable Rufus Choate, which focused on the constitutional tenure of the office of Justice of the Peace and defended the public character and services of Mr. Carter; The answer and defense provided by James G. Carter in response to the specific allegations made by the petitioners; The closing arguments delivered by the Honorable Pliny Merrick, which addressed the petitioners' allegations and the evidence they provided. The final report of the Joint Special Committee, which recommended that the petitioners be given "leave to withdraw their petition," effectively dismissing the attempt to remove Carter from office. Choate, a Massachusetts lawyer, orator and politician, is considered one of 19th-century America's greatest lawyers for his powers of persuasion and innovation in the courtroom. Boston : George C. Rand & Co., 1849. (illustrator).
