Zustand: Nuevo. El proceso de integración europea lleva implícita la profundización paulatina del alcance del proyecto diseñado inicialmente en los años cincuenta. Esto se ha venido produciendo desde el mismo Tratado de Roma, pero muy especialmente a lo largo de los últimos veinte años, con el Acta Onica Europea, el Tratado de Maastricht, y los Tratados de Amsterdam y de Niza. La conclusión de cada nuevo Tratado de revisión, condicionada siempre por las circunstancias históricas del momento, ha constituido un nuevo puente, de una sola dirección, hacia una nueva modificación del derecho originario y por ende, de la Unión Europea. El reto que planteaba, desde esta perspectiva, la elaboración de un nuevo Tratado de revisión era, desde luego, enorme, y ha cristalizado finalmente en el Tratado por el que se establece una Constitución para Europa, firmado por los Jefes de Estado y de Gobierno el pasado 29 de octubre de 2004.El estudio que ahora se presenta se ha organizado en torno a tres ejes principales. Así, después de un breve recorrido por los distintos procesos de revisión que han experimentado los Tratados en los que se funda la Unión Europea, objeto de la primera parte, se aborda la cuestión de la naturaleza jurídica del Tratado por el que se establece una Constitución para Europa. Desde esta perspectiva, esta segunda parte se centra en el análisis de los aspectos que, en su caso, podrían llevar a una formalización constitucional del Tratado, por ahora lejana debido a la importante dimensión iusinternacionalista de todo el proceso de integración. En la tercera parte se examina hasta qué punto las propuestas que incorpora el nuevo Tratado sostienen una cierta tendencia intergubernamental que parece actualmente implícita en el proceso. Se trata pues de examinar, en definitiva, cómo se reorganizan las relaciones interestatales subyacentes en la Unión Europea, bien reforzando su naturaleza intergubernamental, bien profundizando en el camino de la integración.…
