Hugo se montre conscient d'une graduation dans les formes de la violence, comme si, à mesure que la société française s'approchait du but, les formes prises par la violence s'exacerbaient. ''L'avenir est un monstre avant d'être un archange''., Mais il ne délaisse pas ici l'analyse sociale. De même que, très vite, l'analyse politique ressurgit ; défense de la République et de la Révolution. Mais la violence paroxystique de L'Année terrible est constatée par Hugo comme faisant partie des hors-normes : temps de dérèglement, où l'esprit s'efface devant l'instinct, d'où la nécessité de réaffirmer qu'au dessus de l'un et de l'autre surnage ce principe supérieur : le droit. Or, affirme Hugo, dans la France de 1871, ''la loi opprime le droit''. Dès 1830, Hugo avait résumé en une formule forte son sentiment sur les rapports du pouvoir, du droit et de la violence : ''En matière de pouvoir, toutes les fois que le fait n'a pas besoin d'être violent pour être, le fait est droit''.
