Hill and Barton, publishers of the New Hampshire Patriot and Star Gazette, accused Upham of impropriety during his time as Collector of Customs at Portsmouth and "impaired his candidacy for Governor by calling him a smuggler and a federalist" (Cohen). Upham sued for damages of $10,000; the trial resulted in a hung jury and the case was slated for retrial at the court's next session.
