Joy | 19 Augt. 1844'. A significant and interesting letter, on a topic later tackled by Dickens in 'Bleak House', by a judge who was an active member of the Law Am…endment Society, and whose decisions, according to his entry in the Oxford DNB, 'were frequently the subject of comment', although 'very few of his judgments were reversed on appeal'. Fane sympathises with Joy's 'misfortunes', as he does 'with the case of every man, who has the misfortune to be involved in a Chancery suit'. There is however nothing that he could proposer, 'relating to Insolvency or Bankruptcy', that could 'redress the wrongs to wh. the delays of Chancery have subjected you'. The main cause of these delays is the 'tossing of the suitor from the Judge to the Master, & from the Master to the Judge, till the subjt. in dispute is wasted in expense'. The only remedy is for the judge to be compelled 'to carry out his own desires without references to Masters', or to 'so raise the station, power & responsibilities of Masters as that they shall become independent judges'. Small contemporary cutting laid down at head of first page, reading 'SUBDIVISION COURT, WEST SIDE. | Commissioners. | Sir Charles Frederick Williams, kt. Josh. Evans, esq., hon. Robert G. Moderate toning to interior, light foxing and early marks in pencil in a few places, Wadhams's owner label to head of title page. $100. * The Bankruptcy Act of 1867 was the third attempt to create a Federal bankruptcy system. The first two acts, passed in 1800 and 1841, both lasted about a year. Never popular, they were seen as safeguards for financial recklessness and were allowed to expire. Other attempts, most notably a bill proposed in 1841 by Daniel Webster, were defeated. Around 1865, however, Congress began to see bankruptcy protection as a way to encourage the economic redevelopment of the devastated southern states and the expansion of the national post-war economy. These needs informed the passage of the 1867 act. Again, the act proved unpopular and was repealed in 1878. Bankruptcy protection would not become a permanent part of U.S. law until 1898. This paper was written in dissent from an 1841 report that recommended further steps towards the abolition of imprisonment for debt, such as the end of arrest before a bankruptcy suit had concluded. Law, a barrister and one of the comissioners of bankruptcy, "argued that arrest had a chilling effect on reckless indebtedness, and this outweighed any cost of the system" (Lester). A good copy in its original state. $150. * Bankruptcy reform was an important (and perennial) topic in British politics, and a number of parliamentary committees were established to examine the issue in the eighteenth and nineteenth centuries. This report concerns the Insolvent Debtors (England) Act of 1813 and a subsequent act clarifying some of its provisions (53 Geo. 3. c. 102 and 54 Geo. 3. c. 13). The Act attempted to improve conditions for those in debtors' prisons by creating a special appeals court where prisoners could apply for release on conditions negotiated with their creditors. (This court remained in existence until 1861.) The report concluded that the court was insufficiently attuned to the needs of creditors and too generous to debtors. Pre-1836 Parliamentary papers are scarce today. They were not available to the public, so they were produced in small numbers.

This report concerns the Court for the Relief of Insolvent Debtors, which was established by an 1813 statute in an attempt to improve conditions for those in debtors' prisons. The conflict between the welfare of prisoners and the rights of their creditors was a frequent topic of these reports, with some concluding that the court was too lenient and others concluding that it was too harsh. Bankruptcy law gradually liberalized until imprisonment for debt was ended for most cases in 1869. Pre-1836 Parliamentary papers are scarce today. They were not available to the public, so they were produced in small numbers.

Small printed slip relating to the Court of Bankruptcy, bearing Fonblanque's name, laid down at head of first page. Folded… four times for postage. Signed 'J S M Fonblanque'. Minuted in another hand: 'Mr Spence to G Joy / 6th Aug 1844 / enclosing Mr Fonblanque's letter to him.' Begins: 'Dear Spence / I have skimmed Mr Joy's Pamphlet and I do not find in it anything relating to myself nor indeed can I imagine how there could be. The point before me was wh[ethe]r under Brougham's [?] Act a Prisoner could be released by the C[our]t of B[an]k[ru]ptcy - I gave Joy the usual protection, leaving the point of release to the Court under proofs of which he was in custody.' He concludes by stating that the amended act will provide for such cases.

A rare compilation from assemblies of the Royal Boroughs of suggested improvements to the Bills of Exchange (Scotland) Act of 1772, which marked the birth of…the process of sequestration which remains the core of Scottish bankruptcy law. The act, which mitigated the effects of the British Credit Crisis of 1772-3, was criticised for being too inclusive and therefore ineffective and the author of this pamphlet rebuts those claims. Dating the pamphlet is challenging: ESTC contains two records, one dated [1775?] and the other [between 1772 and 1773?], seemingly referring to the same publication - but the former lists holdings in the NLS only whereas their own cataloguing has been changed to [1772?]. The text references the act of 1772 repeatedly, but also refers to ?the American war?, and the expected expiry of the act - suggesting that it actually post-dates 1776 and predates the act?s renewal in 1779, since it had initially lasted 7 years then was renewed until the Payment of Creditors (Scotland) Act 1783 replaced it. All together we have traced four recorded copies: two in the NLS, one in the BL, and one in Glasgow (where the catalogue gives the date as [17--]).
