Taschenbuch. Zustand: Neu. Neuware - Remedy and RedemptionThis book has been painstakingly researched and written in hopes of enabling the basic humane treatment for all those incarcerated in the United States today and in the future.Mr. Tripati has specializations in Public International Law, Public Law, and European Law. As st…ated in Living Designs Inc., et al., v E.I.DuPont De Nemours And Company, et. Al., 431 F.3d 353 (9th Cir.2005)'Membership in the bar is a privilege burdened with conditions. An attorney is received into that ancient fellowship for something more than private gain. He becomes an officer of the court and like the court itself, an instrument or agency to advance the ends of justice.'In re Integration Of Nebraska State Bar Assn 275 N.W. 265, 268 (1937) providesAn attorney owes his first duty to the court. He assumed his obligations toward it before he ever had a client. His oath requires him to be absolutely honest even though his client's interest may seem to require a contrary course. The (lawyer )cannot serve two masters and the one (the lawyer has) undertaken to serve primarily is the court.'Very often lawyers who conceal/falsify evidence in their zeal to win forget their duties. As Living Designs states relying on DiSabatino v US Fidelity & Guaranty Co, 635 F.Supp. 35, 355 (D.De. 1986) when settlement is procured by fraud, it need not be shown there was a good cause of action at the time of the fraud. 'The probable amount of settlement in the absence of fraud after considering all known or foreseeable facts and circumstances affect-ing the value of the claims on the date of settlement' is the issue. 'Whether the defrauded part could have won its case is irrelevant to this calculation.'This book addresses just that showing avenues for seeking relief. Lawyers should refrain from fraudulent acts. 'The Degree of a civilization can be judged by entering its prisons'.

Taschenbuch. Zustand: Neu. Neuware - An Inexplicable Deformity Volume 1This book has been painstakingly researched and written in hopes of enabling the basic humane treatment for all those incarcerated in the United States today and in the future.Mr. Tripati has specializations in Public International Law, Public Law, and Europe…an Law. The Prison Litigation Reform Act (PLRA) and its counterpart the Antiterrorism And Effective Death Penalty Act Of 1996 (AEDPA) violate Art 2.3(a) ICCPR for they require exhaustion of ineffective administrative and judicial remedies Eugene Novikov, Comment Stacking The Deck: Futility And The Exhaustion Provision Of the Prison Litigation Reform Act, 156 U. Pa .L .Rev. 817 (2008) Mark Tushnet & Larry Yackle, Symbolic Statutes And Real Laws: The Pathologies Of The Substances Of The Antiterrorism And Effective Death Penalty Act and the PLRA, 47 Duke L.L. 1 (1997). In Ross v Blake, (2016) No. 15-379 Justice Kagan stated 'as Booth made clear an administrative procedure is unavailable when (despite what regulation or guidance materials may promise) it operates as a simple dead end.with officers unable or consistently unwilling to provide any relief to aggrieved inmates. In short PLRA renders all remedies for prisoners ineffective within the meaning of Art. 2.3(a) ICCPR. Because of Congressional restrictions prisoners, notwithstanding the fact that they are being subjected to human rights abuses in state prisons, do not have the same access to the courts as non-prisoners, and the limited access they have are futile, under a heightened standard. During litigation prison authorities are allowed to conceal evidence of misconduct and do not have to provide the same disclosure that non prisoners are given Rule 26(a)(1)(B)(iv) Federal Rules of Civil Procedure. As such prisoners' accesses to courts violate Art. 14.1 ICCPR. Frowein and Perkert, Europaische Menschenrechts Konvention: EMRK-Kommentar; (2nd ed. 1996)Because of PLRA prisoners are increasingly tortured, subjected to cruel, inhumane, degrading treatment and punishment in violation of Art. 7 ICCPR; Green, The European Court Of Human Rights, (2006) prisoners are not treated with humanity as required by Art. 10.1 ICCPR; their rights to freedom of thought, conscience, religion as required by Art. 18.1 and 27 ICCPR is violated; retaliation for petitioning the courts and government is the norm in violation of Art. 25.a ICCPR. In short PLRA encourages ICCPR and human rights violations Malcolm M. Feley & Van Swearingen, The Prison Conditions Cases and The Bureaucratization Of American Corrections: Influences, Impacts and Implications; 24 Pace L. Rev. 433 (2004) describes the increase in prison litigation due to prison authorities that violation human rights How Prisoners' Rights Lawyers Are Preserving the Role Of the Courts, 69 U. Miami L. Rev.'The Degree of a civilization can be judged by entering its prisons'.

Taschenbuch. Zustand: Neu. Neuware - A Hollow Remedy Volume 1This book has been painstakingly researched and written in hopes of enabling the basic humane treatment for all those incarcerated in the United States today and in the future.Mr. Tripati has specializations in Public International Law, Public Law, and European Law. RE…ASONS WHY REMEDY IS HOLLOWArizona prosecutors with the help of state judges create situations in cases they know they may not pre-vail force defense counsel ask for mistrials. Though the Arizona Attorney general and courts know of this practice they decline to take any action. The Arizona Attorney general in proceedings in the Superior Court has made it a practice that relief by way of special action is not available. They however consistently deceive federal courts taking contrary positions, so as to defeat claims.Aware that in Arizona PCR proceedings with appointed counsel are meaningless as counsel do not expend the resources to ensure claims are reviewed the Attorney General conceals these facts.Arizona does not have a law library and have a paralegal system made of paralegals, not able to afford inmates assistance. By their policies they forbid paralegals from assisting inmates in marshalling facts and arguments. However they argue in the course of federal proceedings that inmates have failed to comply with technical provisions of the rules. They obtain mental health from mental health practitioners who are willing to say anything to appease state authorities. Aware of this fact the Arizona Attorney general consistently misrepresents facts to the court to prevail. 'The Degree of a civilization can be judged by entering its prisons'.

CONTINUED FROM VOLUME 1: The following reveals Corizon Inc.; Wexford Heath Services and State authorities have systematically mislead and perpetrated intentional frauds upon the court in order to corrupt the legitimate outcome of justice. These entities have withheld and manipulated evidence and events with virtual impunity. The following supports this conclusion.A PATTERN OF DELIBERATE INDIFFERENCEKEVIN MITCHELL, PLAINTIFF, V. CORIZON HEALTH, INC., ET AL., DEFENDANTS. 2015 U.S. Dist. LEXIS 9759 (January 28, 2015)On July 9, 2014, Plaintiff Kevin Mitchell, who is represented by counsel, filed a Complaint in the Maricopa County Superior Court. On August 5, 2014, Defendants Corizon Health, Inc. (Corizon) and the State of Arizona removed the action to this Court. On August 13, 2014, Defendants Corizon and State of Arizona filed an Answer to the Complaint. In a November 3, 2014 Order, the Court dismissed the Complaint because Plaintiff had failed to state a claim. The Court gave Plaintiff 30 days to file an amended complaint that cured the deficiencies identified in the Order. On December 3, 2014, Plaintiff filed his First Amended Complaint (Doc. 7). The Court will dismiss Plaintiff's federal claim against Talboy, order Corizon to answer Plaintiff's federal claim against it, and order Corizon, the State, and Talboy to answer Plaintiff's state law claim.II. First Amended ComplaintIn his two-count First Amended Complaint, Plaintiff sues Corizon, Registered Nurse Patricia Talboy, and the State. Plaintiff demands a jury trial and seeks monetary damages, pre- and post-judgment interest, and his attorneys' fees and costs.Plaintiff contends that the State has entered into contracts, first with one private health care provider and then with Corizon, to administer and provide health care to Arizona inmates. Plaintiff contends that the State and Corizon have been unwilling to appropriately staff Arizona prisons with sufficient and competent health care providers.'The Degree of a civilization can be judged by entering its prisons'.
