Aujourdhui, bien que le mariage relève principalement du droit privé, le droit canonique et également le droit public aspirent généralement à un règlement exhaustif. Celui-ci place sous surveillance assez rigoureuse les conditions, la formation et la dissolution du mariage, afin que le mariage, une fois contracté, se maintienne.
