A scarce contemporary legal brief in one of the most celebrated American copyright controversies of the nineteenth century, involving Richard Henry Dana, Jr., author of Two Years Before the Mast, and William Beach Lawrence, a prominent authority on international law. The dispute arose from competing annotated editions of Henry Wheaton's influential Elements of International Law. Lawrence had edited the 1855 and 1863 editions, but Dana was selected to prepare a new edition published in 1866. Lawrence subsequently brought suit, alleging that Dana had appropriated substantial portions of his original editorial scholarship, including annotations, references and citations. This reply, submitted on Dana's behalf in 1869, responds to the arguments advanced by Lawrence's counsel, former U.S. Supreme Court Justice Benjamin Robbins Curtis. The litigation raised fundamental questions concerning the copyright protection of scholarly annotations and compilations, the distinction between common legal authorities and original editorial contributions, and the permissible use of earlier editions in preparing subsequent works. In Lawrence v. Dana (1869), Circuit Justice Nathan Clifford recognized that original editorial annotations and other scholarly contributions could receive independent copyright protection, even when incorporated into an edition of an earlier work. The controversy became an important episode in the development of American copyright doctrine concerning derivative scholarship and the rights of editors and commentators.
