This collection of essays explores the various contexts in which restorative justice can be applied, highlighting its elusive nature and how its meaning can shift based on the needs of individuals and communities. Restorative justice extends beyond criminal law and corrections, encompas…sing civil disputes, civil rights, interpersonal relationships, and personal growth. The essays cover a wide range of topics, including housing discrimination, family disputes, the war on drugs, the death penalty, juvenile courts, and more. The book encourages both action and reflection. Sheila M. Murphy, a retired Illinois trial judge, has a notable background, having presided over significant cases, including that of Verneal Jimerson, who was exonerated after being wrongfully condemned to death. In retirement, she has advocated against the death penalty, notably in the case of Dominique Green, featured in a book by Thomas Cahill. Murphy has also lectured internationally on restorative justice. Michael P. Seng, a professor at The John Marshall Law School, focuses on constitutional law and civil rights. He co-directs the Fair Housing Legal Support Center and Clinic and has extensive legal experience, including civil rights litigation. Together, Murphy and Seng have designed a unique restorative justice course for law students, who then engage with local schools and communities.

Taschenbuch. Zustand: Neu. Neuware - How the Courts Work provides a plain English, straightforward explanation of the American court system. The authors take the reader step by step through both a civil and a criminal trial, revealing what actually happens in a courtroom from the perspective of the lawyers, the parties, and the…judge. Along the way, the reader will learn the difference between federal and state courts, and between the work of trial judges and appellate judges such as those on the Supreme Court. The authors explain how judges get their jobs, basic constitutional rights that apply in criminal cases, plea bargaining, significant pre-trial procedures, and the difference between criminal and civil law issues. Importantly, this book eliminates much of the mystery of courtroom proceedings. It is an invaluable guide for anyone who has a case, or is thinking about having a case, in our courts. The book provides an overview of the entire litigation process, and so meets an urgent need for law students, paralegals, and new lawyers who have never handled a case from beginning to end. About the Author: Marilyn Englander received her bachelor's degree from Harvard University, where she met co-author Curtis Karnow. She went on to complete an interdisciplinary PhD in history, anthropology and religious studies at University of California, Santa Barbara. After 25 years of teaching humanities courses at middle school through university-level, she established her own school, REAL School Marin, in Marin County, California. Her teenage students focus on personal and civic responsibility as well as global citizenship through studying American history, government and conflict resolution. Curtis Karnow is a judge on the San Francisco Superior Court. He is the author of FUTURE CODES: ESSAYS IN ADVANCED COMPUTER TECHNOLOGY AND THE LAW (Artech House), contributory co-author of E-BUSINESS AND INSURANCE (CCH) (chapters on Internet security, copyright, trademarks and trade dress, indirect liability on the internet), INTERNATIONAL E-COMMERCE (CCH) (privacy & security), NETWORK SECURITY: THE COMPLETE REFERENCE (McGraw-Hill), and CYBERCRIME: DIGITAL COPS IN A NETWORKED ENVIRONMENT (NYU Press). He is consulting editor on ACTION GUIDE: HANDLING EXPERT WITNESSES IN CALIFORNIA COURTS (CEB); and CALIFORNIA CIVIL DISCOVERY PRACTICE (CEB). Topics of his law review articles range from artificial intelligence to summary judgment and game theory. Judge Karnow is married to the other author of this book, and together they have two children, Benjamin and Jean.

Taschenbuch. Zustand: Neu. Neuware - Cracking the Case Method is a concise and down-to-earth guide to the intellectual content of law school instruction, particularly in the first year. Readers will discover why and how law school instructors use appellate court cases as vehicles for teaching legal analysis. This book explains t…hat legal analysis is a process by which judges and lawyers use argument (or rhetoric) to connect stories to legal conclusions, and reveals how to read judges' appellate court opinions as arguments rather than merely as sources of rules. To succeed in law school, students have to apply analytical skills to novel stories by crafting arguments of their own, both in class meetings and when answering final examination essay questions. This book promotes readers' ability to apply analytical skills by: - Demonstrating how to 'brief' cases in a way that captures both arguments and rules; - Explaining and illustrating common types of arguments; - Using actual law school classroom dialogues annotated by the authors to explain how instructors use classes to further law schools' goal of teaching argument skills; - Setting forth effective final examination preparation strategies and techniques for crafting answers that demonstrate analytical skills; and - Illustrating final exam strategies and techniques by providing actual law school final examination questions followed by model answers annotated by the authors. The subjects that readers will study in law school (whether rules of contracts or processes such as jury trials) all emanate from the Common Law Tradition. To further enhance readers' analytical understanding and skills, the book concludes with a chapter that provides a brief and colorful overview of this rich and fascinating tradition. The chapter includes comparisons to the common law tradition's Civil Law counterparts, enhancing the book's value to all readers. If you want to achieve academic success in law school, this book provides you with the tools you need to Crack the Case Method. Reviews: 'Law school study fundamentally differs from university study. Most first year law students therefore find the transition from college to law school difficult and bumpy. This book explains the differences and gives a thorough guide to what it takes to do well in law school, especially during that crucial first year. Students who want a significant edge over their classmates will read it before the first day of 1L. I wish I had.' Alex Kozinski Chief Judge of the United States Court of Appeals for the Ninth Circuit 'The Authors provide an accessible and often humorous guide to the Case Method. In addition to demystifying legal studies for the new student, the book provides a sound foundation for the future practitioner; the object of the Case Method, in the main, is to allow the application of legal principles to help clients resolve their problems.' Hector G. Gallegos Partner and Head of Morrison & Foerster LLP's Los Angeles Litigation Department 'Legal education and the legal profession are in the midst of a profound restructuring brought on by a revolution in technology and dramatic changes in the economy. In the midst of such change, Cracking the Case Method is a critically important work that will help all law students develop a lawyer's most important tool - using the venerable case method to carry out legal analysis and to hone their analytical skills - the essence of every lawyer's work. Cracking the Case Method is not an abstract academic exercise, but a nuts and bolts, how to approach to analysis that will train better lawyers and promote just results in our judicial system. The case method may be over 100 years old but how to use it as an effective tool for good lawyering has never been done like it is in these pages.' Jeffrey S. Brand Dean and Professor of Law University of San Francisco School of Law.

Taschenbuch. Zustand: Neu. Neuware - Today's legal landscape is increasingly demanding practical skills from recent law school graduates and new attorneys. In light of this, the authors realized that there was a gap between theory and praxis with regards to family law in Florida. This workbook bridges this gap by designing an ea…sily accessible book that better equips students and attorneys with the skills, confidence, and experience needed to serve the community with the highest level of professionalism. As a result, this workbook has multiple uses and benefits. It can serve as a teaching tool for professors. It also may be used by individuals who plan to take the Florida Bar and wish to use it as a study guide. Furthermore, this workbook can serve as a valuable legal resource for new attorneys who plan to practice family law in Florida. In an effort to accelerate and optimize the users' learning process, this workbook utilizes a fictional community of families that provide the scenarios for hypothetical exercises that are integral to the honing of practical legal skills. In the exercises, users will be required to perform real-life legal tasks for one or more families from this fictional community. The workbook includes relevant statute(s), case law, and internet links for the user who needs to act on or resolve a family law issue. Each chapter also includes a checklist, though not exhaustive, of key interview questions to ask a client. The authors hope users enjoy delving into these scenarios and finish this book better prepared to meet the marketplace's demands.

Zustand: Gut. Zustand: Gut | Seiten: 716 | Sprache: Englisch | Produktart: Bücher | Tort Law: The American and Louisiana Perspectives, Third Revised Edition has as its primary objective a study of tort law in the United States and Louisiana. It differs from most other torts casebooks, however, in that it has a secondary objectiv…e of providing an exercise in comparative law. In the United States, we often overlook the fact that the common law system that prevails in our nation is not the only legal system in the world. Much of the world applies a civil law approach in which a civil code has a more prominent role than case law. In a world in which trade and economics, politics, and law cross national borders, it has become increasingly important to be aware of and conversant in other nations' legal systems. Louisiana, the only state in the United States that can be described as a mixed jurisdiction, using both civil law and common law, provides an excellent model for examining and comparing and contrasting civil law and common law approaches to various legal issues. This book invites the reader to both study tort law and consider the differences and similarities between the common law states and a state that has a civil code and views the role of the courts and the legislature somewhat differently.

Zustand: Hervorragend. Zustand: Hervorragend | Sprache: Englisch | Produktart: Bücher | The legal cosmos is every bit as weird as anything dreamed up in science fiction. Nothing from the famous bar scene in Star Wars can trump government-issued penis pumps, talking urinal cakes or burglars who rub spices on their victims and the…n attack them with a sausage. But all of these are part of the legal landscape Justice William W. Bedsworth, a respected appellate judge and award-winning columnist, tries to make sense of here. Make no mistake, "Beds" is as baffled as the rest of us. But his attempts to sort it out have been entertaining lawyers and other humans all over America for decades. This third collection of the best of his nationally-syndicated column "A Criminal Waste of Space" may not help you understand the law, but you'll be laughing too hard to care. "If you're holding this book in your hands - as you no doubt must be - just start turning pages and get ready for a treat." Alex Kozinski, 9th Circuit Court of Appeals "This is a must read for lawyers and non-lawyers alike - anyone who wants to enjoy the legal perspective of the human comedy from a truly down-to-earth judge who has seen it all." Carlos Moreno, United States Ambassador to Belize "Beds offers fresh perspective and hilarious anecdotal asides to somehow explain the unexplainable. His storytelling is as unique as the background from which his sharp wit has been fostered. If you like to laugh, you'll love this book!" Tim Ryan, C.O.O., Anaheim Ducks Hockey Club.

Taschenbuch. Zustand: Neu. Neuware - Across the globe and particularly in America, basic democratic tenets supposedly stand on principles of fairness and equity, but almost everything we've done and are doing rejects that these ideals are important to us. Instead, we consciously or subconsciously embrace a predilection and desir…e for preferential treatment for preferred people. Nowhere is our support of preference starker than in the way 'racial haves' sustain their mistreatment of the 'racial have-nots.' It occurs in every facet of American life and is evident across the globe. This book examines a single area of our culture: housing in the US which operates against the backdrop of unrelenting segregation policies and practices in all facets of the industry. So vitriolic is the housing industry against people of color, particularly African Americans, that even sweeping legislation like the Fair Housing Act itself could not stamp out the offensive systemic actions within the housing industry. Acknowledging the depths of prejudice supported by centuries of falsehoods and malevolence, the author calls for transformational change in American culture to reach racial balance in housing and concomitant industries.
