Buch. Zustand: Neu. Neuware - Global Justice Reform critiques and rethinks two neglected subjects: the nature of comparison in the field of comparative law and the struggles of national judicial systems to meet global rule of law objectives. Hiram Chodosh offers a candid look at the surprisingly underdeveloped methodology of comparative legal studies, and provides a creative conceptual framework for defining and understanding the whys, whats, and hows of comparison. Additionally, Chodosh demonstrates how theories of comparative law translate into practice, using contemporary global justice reform initiatives as a case study, with a particular focus on Indonesia and India. Chodosh highlights the gap between the critical role of judicial institutions and their poor performance (for example, political interference, corruption, backlog, and delay), discussing why reform is so elusive, and demonstrating the unavoidable and essential role of comparison in reform proposals. Throughout the book, Chodosh identifies several sources of comparative misunderstanding that impede successful reforms and identifies the many predicaments reformers face, detailing a wide variety of designs, methods, and social dilemmas. In response to these seemingly insurmountable challenges, Chodosh advances some novel conceptual strategies, first by drawing on a body of non-legal scholarship on self-regulating, emergent systems, and then by identifying a series of anti-dilemma strategies that draw upon insights about the nature of comparison.…

Buch. Zustand: Neu. Neuware - Both the courts and the public seem confused about sexual harassment-what it is, how it functions, and what sorts of behaviors are actionable in court. Theresa M. Beiner contrasts perspectives from social scientists on the realities of workplace sexual harassment with the current legal standard. When it comes to sexual harassment law, all too often courts (and employers) are left in the difficult position of grappling with vague legal standards and little guidance about what sexual harassment is and what can be done to stop it. Often, courts impose their own stereotyped view of how women and men 'ought' to behave in the workplace. This viewpoint, social science reveals, is frequently out of sync with reality. As a legal scholar who takes social science seriously, Beiner provides valuable insight into what behaviors people perceive as sexually harassing, why such behavior can be characterized as discrimination because of sex, and what types of workplaces are more conducive to sexually harassing behavior than others. Throughout, Beiner offers proposals for legal reform with the goal of furthering workplace equality for both men and women.…

Buch. Zustand: Neu. Neuware - The first full-length study of transgender representations in art, fiction, film, video, and music In his first book since the critically acclaimed Female Masculinity, J. Jack Halberstam examines the significance of the transgender body in a provocative collection of essays on queer time and space. He presents a series of case studies focused on the meanings of masculinity in its dominant and alternative forms' especially female and trans-masculinities as they exist within subcultures, and are appropriated within mainstream culture. In a Queer Time and Place opens with a probing analysis of the life and death of Brandon Teena, a young transgender man who was brutally murdered in small-town Nebraska. After looking at mainstream representations of the transgender body as exhibited in the media frenzy surrounding this highly visible case and the Oscar-winning film based on Brandon's story, Boys Don't Cry, Halberstam turns his attention to the cultural and artistic production of queers themselves. He examines the 'transgender gaze,' as rendered in small art-house films like By Hook or By Crook, as well as figurations of ambiguous embodiment in the art of Del LaGrace Volcano, Jenny Saville, Eva Hesse, Shirin Neshat, and others. He then exposes the influence of lesbian drag king cultures upon hetero-male comic films, such as Austin Powers and The Full Monty, and, finally, points to dyke subcultures as one site for the development of queer counterpublics and queer temporalities. Considering the sudden visibility of the transgender body in the early twenty-first century against the backdrop of changing conceptions of space and time, In a Queer Time and Place is the first full-length study of transgender representations in art, fiction, film, video, and music. This pioneering book offers both a jumping off point for future analysis of transgenderism and an important new way to understand cultural constructions of time and place.…

Buch. Zustand: Neu. Neuware - Pathbreaking essays on the power of local activism on the broader Civil Rights movement Over the last several years, the traditional narrative of the civil rights movement as largely a southern phenomenon, organized primarily by male leaders, that roughly began with the 1955 Montgomery Bus Boycott and ended with the Voting Rights Act of 1965, has been complicated by studies that root the movement in smaller communities across the country. These local movements had varying agendas and organizational development, geared to the particular circumstances, resources, and regions in which they operated. Local civil rights activists frequently worked in tandem with the national civil rights movement but often functioned autonomously from-and sometimes even at odds with-the national movement. Together, the pathbreaking essays in Groundwork teach us that local civil rights activity was a vibrant component of the larger civil rights movement, and contributed greatly to its national successes. Individually, the pieces offer dramatic new insights about the civil rights movement, such as the fact that a militant black youth organization in Milwaukee was led by a white Catholic priest and in Cambridge, Maryland, by a middle-aged black woman; that a group of middle-class, professional black women spearheaded Jackson, Mississippi's movement for racial justice and made possible the continuation of the Freedom Rides, and that, despite protests from national headquarters, the Brooklyn chapter of the Congress of Racial Equality staged a dramatic act of civil disobedience at the 1964 World's Fair in New York. No previous volume has enabled readers to examine several different local movements together, and in so doing, Groundwork forges a far more comprehensive vision of the black freedom movement.…

Buch. Zustand: Neu. Neuware - Religious institutions are among the most segregated organizations in American society. This segregation has long been a troubling issue among scholars and religious leaders alike. Despite attempts to address this racial divide, integrated churches are very difficult to maintain over time. Why is this so How can organizations incorporate separate racial, ethnic, and cultural groups Should they And what are the costs and rewards for people and groups in such organizations Following up on Michael O. Emerson and Christian Smith's award-winning Divided by Faith, Against All Odds breaks new ground by exploring the beliefs, practices, and structures which allow integrated religious organizations to survive and thrive despite their difficulties. Based on six in-depth ethnographies of churches and other Christian organizations, this engaging work draws on numerous interviews, so that readers can hear first-hand the joys and frustrations which arise from actually experiencing racial integration. The book gives an inside, visceral sense of what it is like to be part of a multiracial religious organization as well as a theoretical understanding of these experiences.…

Buch. Zustand: Neu. Neuware - Jewish Girls Coming of Age in America, 1860-1920 draws on a wealth of archival material, much of which has never been published-or even read-to illuminate the ways in which Jewish girls' adolescent experiences reflected larger issues relating to gender, ethnicity, religion, and education. Klapper explores the dual roles girls played as agents of acculturation and guardians of tradition. Their search for an identity as American girls that would not require the abandonment of Jewish tradition and culture mirrored the struggle of their families and communities for integration into American society. While focusing on their lives as girls, not the adults they would later become, Klapper draws on the papers of such figures as Henrietta Szold, founder of Hadassah; Edna Ferber, Pulitzer Prize-winning author of Showboat; and Marie Syrkin, literary critic and Zionist. Klapper also analyzes the diaries, memoirs, and letters of hundreds of other girls whose later lives and experiences have been lost to history. Told in an engaging style and filled with colorful quotes, the book brings to life a neglected group of fascinating historical figures during a pivotal moment in the development of gender roles, adolescence, and the modern American Jewish community. …

Buch. Zustand: Neu. Neuware - For most people, the terms 'evangelical' and 'feminism' are contradictory. 'Evangelical' invokes images of conservative Christians known for their strict interpretation of the Bible, as well as their support of social conservatism and traditional gender roles. So how could an evangelical support feminism, a movement that seeks, at its most basic level, to redress the inequalities, injustice, and discrimination that women face because of their sex Evangelical Feminism offers the first history of the evangelical feminist movement. It traces the emergence and theological development of biblical feminism within evangelical Christianity in the 1970s, how an internal split among members of the movement came about over the question of lesbianism, and what these developments reveal about conservative Protestantism and religion generally in contemporary America. Cochran shows that biblical feminists have been at the center of changes both within evangelicalism and in American culture more broadly by renegotiating the religious symbols which shape its deepest values.…

Buch. Zustand: Neu. Neuware - Blacks, Hispanics, and Asians represent three of every four immigrants who arrived in the United States after 1970. Yet despite their large numbers and long history of movement to America, non-Europeans are conspicuously absent from many books about immigration. In Other Immigrants, David M. Reimers offers the first comprehensive account of non-European immigration, chronicling the compelling and diverse stories of frequently overlooked Americans. Reimers traces the early history of Black, Hispanic, and Asian immigrants from the fifteenth century through World War II, when racial hostility led to the virtual exclusion of Asians and aggression towards Blacks and Hispanics. He then tells the story of post-1945 immigration, when these groups dominated the immigration statistics and began to reshape American society. The capstone to a lifetime of groundbreaking work on immigration, Reimers's thoughtful history recognizes the ambiguity and subjectivity of race, noting that individuals often define themselves more complexly than census forms allow. However classified, record numbers of immigrants are streaming to the United States and creating the most diverse society in the world. Other Immigrants is a timely account of their arrival.…

Buch. Zustand: Neu. Neuware - What ends do we expect and hope to serve in punishing criminal wrongdoers Does the punishment of offenders do more harm than good for American society In The Case against Punishment, Deirdre Golash addresses these and other questions about the value of punishment in contemporary society. Drawing on both empirical evidence and philosophical literature, this book argues that the harm done by punishing criminal offenders is ultimately morally unjustified. Asserting that punishment inflicts both intended and unintended harms on offenders, Golash suggests that crime can be reduced by addressing social problems correlated with high crime rates, such as income inequality and local social disorganization. Punishment may reduce crime, but in so doing, causes a comparable amount of harm to offenders. Instead, Golash suggests, we should address criminal acts through trial, conviction, and compensation to the victim, while also providing the criminal with the opportunity to reconcile with society through morally good action rather than punishment.…
