There is a gap of nearly a hundred years between those early prohibitions of pillage and the prohibition of rape finally enacted in the Rome Statute of 1998. In Looting and Rape in Wartime, Tuba Inal addresses the development of these two separate "prohibition regimes," exploring why states make and agree to laws that determine the way war is conducted, and what role gender plays in this process., Inal argues that three conditions are necessary for the emergence of a global prohibition regime: first, a state must believe that it is necessary to comply with the prohibition and that to do otherwise would be costly; second, the idea that a particular practice is undesirable must become the norm; finally, a prohibition regime emerges with state and nonstate actors supporting it all along the way. These conditions are met by the prohibition against pillage, which developed from a confluence of material circumstances and an ideological context: the nineteenth century fostered ideas about the sanctity of private property, which made the act of looting seem more abhorrent. Meanwhile, the existence of conscripted and regulated armies meant that militaries could take measures to prevent it. In that period, however, rape was still considered a crime of passion or a symptom of behavioral disorder - in other words, a distortion of male sexuality and outside of state control - and it would take many decades to erode the grip of those ideas. The fight took an ethnic turn as soldiers from the country's largest groups, the Dinka, and Nuer, divided their loyalties to either President Kiir or Mr. Machar respectively. While some civilians were caught in the crossfire, others were deliberately targeted along ethnic lines. Women are the immediate victims of this conflict because of rampant sexual abuse perpetrated against them. The gender discrimination South Sudanese women were subjected to in their society before the conflict contributed to their victimization during the conflict. Women suffered in the areas of educational access, domestic violence, non-recognition of marital rape, and forced marriage. Even though South Sudan's constitution, particularly under Article 16, provides full and equal dignity with men, women survivors of rape are still victims of gender-based discrimination due to the prevailing weak justice framework, and thus, victimized twice. Wartime sexual violence including rape, gang rape, and sexual slavery remains a shocking reality in South Sudan today. Women who survive rape face threats and experience trauma including a desire to kill themselves and Post Trauma Stress Disorder (PTSD). They also experience stigma. As a result, many women are very reluctant to report rape. Old women from the enemy's ethnic group are raped in order to make it clear to the enemy that they are incapable of protecting their mothers. The goal is to make the enemy feel emasculated, but women suffer the direct consequence. Women who refuse to be raped are shot through their private parts, and even those who are pregnant are forced into sexual intercourse. Some women become pregnant by their rapist.…

According to UN staff and doctors in the region, all armed groups in theregion are involved in rapes and despite the 2002 Pretoria Accord which put an official endto the war, attacks and rapes continue to this very day. Although the Congolese Penal Code and Military Penal Codepenalize these crimes, the reaction by the Congolese government to the atrocities remainsinsufficient, making a solution based on Congolese criminal law unlikely. The practicalapplication of the D.R.C.'s domestic laws is found wanting and the law does not have thedeterrent effect which is required to prevent future atrocities, also due to the traditionalposition of women in Congolese society continues to be reflected in the law: According toArt. 448 of the D.R.C.'s family code, a married woman has to obtain her husband'spermission to bring a case to court - which provides a major obstacle on the road tojustice. This book deals with the multidimensional aspects of the problem, which rangefrom medicine and psychology to social issues and the quest for justice. In the latter partwe will examine not only the background by looking at relevant rules of InternationalHuman Rights Law and International Humanitarian Law but also look at legal responses tothese crimes both on a national level in the D.R.C. as well as on an international level andwith the question of how justice can be achieved for rape victims in a country ravaged bywar in which women continue to be second class citizens.…
