Nach der ständigen Rechtsprechung erstrecken sich diese jedoch ausnahmsweise auch auf das Drittgeschäft, wenn das Grundstücks- und das Drittgeschäft nach dem Willen der Parteien derart rechtlich voneinander abhängen, dass sie »miteinander stehen und fallen« sollen. Diese Forschungsfrage ist bislang kaum durchdrungen bzw. wissenschaftlich untersucht.
