Method for ending this indecision. The study of the division of labor in itself and for itself. Plan of the book BOOK ONE THE FUNCTION OF THE DIVISION OF LABOR CHAPTER ONE. THE METHOD FOR DETERMINING THIS FUNC- TION Meaning of the word function 1. The function of the division of labor is not to produce civilization 2. Cases where the function of the division of labor is to bring forth groups which would not exist without it. Whence the hypothesis that it plays the same role in higher societies; that it is the principal source of their cohesion PAGE 3. To verify this hypothesis, we must compare the social soli- darity which has this source with other types of solidarity, and accordingly classify them. Necessity for studying solidarity through the system of juridical rules; there are as many classes of juridical rules as there are forms of solidarity. Classifi- cation of juridical rules: rules with a repressive sanction; rules with a restitutive sanction CHAPTER TWO. MECHANICAL SOLIDARITY THROUGH LIKE- NESS 1. The link of social solidarity to which repressive law corre- sponds is the one whose break constitutes a crime. We shall understand this link if we understand what crime essentially is The essential characteristics of crime are those which are found wherever crime occurs, no matter what the social type. Thus, the only characteristics common to all crimes, which are or have been recognized as such, are the following: 1. a crime offends sentiments which are found among all normal indi- viduals of any given society; 2. these sentiments are strong; 3. they are defined. A crime is, then, an act which offends strong and defined states of the collective conscience; exact meaning of this statement. - Examination of a case where the delict is created or at least aggravated by an act of a govern- mental organ. Inclusion of this case in the preceding defini- tion 2. Verification of this definition; if it is exact, it ought to account for all the characteristics of punishment. Determina- tion of these characteristics: 1. punishment is a passionate reaction, of graduated intensity; 2. this passionate reaction emanates from society; refutation of the theory according to which private vengeance would have been the primitive form of punishment; 3. this reaction is enforced through the interme- diary of a constituted body 3. These characteristics can be deduced from our definition of crime: 1. every strongly offended sentiment mechanically determines a passionate reaction; utility of this reaction in maintaining this sentiment. Collective sentiments, being the strongest there are, determine a reaction of the same kind, which is as strong as they are intense. Explanation of the quasi-religious character of expiation; 2. the collective char- acter of these sentiments explains the social character of this reaction; why it is useful for it to be social; 3. the intensity and particularly the defined nature of these sentiments explain the formation of the determinate organ which enforces this reaction 4. The rules which penal law sanctions thus express the most essential social similitudes; consequently, it corresponds to the social solidarity which comes from resemblances, and varies with it. Nature of this solidarity. We can then measure the part it plays in general social integration according to the frac- tion of the complete system of juridical rules which penal law represents CHAPTER THREE. ORGANIC SOLIDARITY DUE TO THE DIVISION OF LABOR 1. The nature of the restitutive sanction implies: 1. that the corresponding rules express excentric states of the common conscience or are foreign to it; 2. that the relations that they determine only link the individual indirectly to society. These relations are positive or negative 2. Negative relations of which real rights are typical. They are negative because they link the thing to the person, not per- sons to each other. Reduction to this type of personal rela- tions which are established as they arise in the exercise of real rights, or through a delict or quasi-delict. - The solidarity that the corresponding rules express, being negative, has no existence of its own, but is only a prolongation of positive forms of social solidarity 3. Positive or co-operative relations which come from the division of labor. Are governed by a defined system of juridical rules which we may call co-operative law; verification of this proposition through the different parts of co-operative law. Conclusion: Two kinds of positive solidarity; one which comes from similitudes, the other from the division of labor. Mechanical solidarity, organic solidarity. The first varies in inverse ratio, the second in direct ratio with individual per- sonality. What repressive law corresponds to; what co-opera- tive law corresponds to CHAPTER FOUR. FURTHER PROOF OF THE PRECEDING If the preceding result is exact, repressive law ought to have as much more preponderance over co-operative law as social- similitudes are more extensive, and the division of labor more rudimentary, and inversely. Juli 1906 in Magdeburg; 21. März 1992 in Köln) war ein deutscher Soziologe, Sprachwissenschaftler und Übersetzer. Er gehört neben Helmut Schelsky und Theodor W. Adorno zu den einflussreichsten Vertretern der deutschen Soziologie der Nachkriegszeit. Leben - Kindheit, Jugend, Studium: René König wuchs zweisprachig auf [1] , seine Mutter war Französin, sein Vater Deutscher. Vor dem Ersten Weltkrieg hielt er sich ebenso häufig in Paris wie in Magdeburg auf und besuchte in beiden Städten die Schule. Königs Offenheit für andere Sprachen wurde auch dadurch geprägt, dass er sich als Kind mit der Familie für längere Zeit in Italien und in Spanien aufhielt. Von 1914 bis 1922 lebte die Familie in Halle an der Saale, wo König das Gymnasium besuchte. 1922 folgte der Umzug nach Danzig, wo der Vater Angestellter des Völkerbundes wurde. In Danzig schloss König 1925 das klassische humanistische Gymnasium mit dem Abitur ab. Danach studierte er an der Universität Wien, vor allem Philosophie und Psychologie aber auch semitische Sprachen. Bis 1927 besuchte er mehrfach die Türkei. Dann wechselte er an die Universität Berlin, wo er Philosophie sowie Kunst- und Kulturwissenschaften bei Max Dessoir und Eduard Spranger sowie Ethnologie bei Richard Thurnwald und Romansitk bei Edurard Wechsler studierte. Dort wurde er 1930 mit einer Arbeit über Die naturalistische Ästhetik in Frankreich und ihre Auflösung promoviert. 1933/35 war König Lektor im Berliner Verlag Die Runde". 1936 meldete er sich bei Alfred Vierkandt in Berlin zur Habilitation an, zu der es aber nicht mehr kam. Nachdem König zunächst an das Vereinigte Königreich dachte, emigriert er Anfang 1937 nach ihm wichtigen Kontaktaufnahmen zu ihn unterstützenden Personen in die deutschsprachige Schweiz. Emigration: König wurde kontrapunktisch zur Festigung des nationalsozialistischen Herrschaftssystems 1934/35 zum politischen Gegner der Nationalsozialisten. Er versuchte zunächst 1933 aus innerer Emigration geistigen Widerstand zu leisten. Nachdem sein Buch Vom Wesen der deutschen Universität 1935 kurz nach dem Erscheinen verboten wurde und er vom SS-Sicherheitsdienst als feindlicher Intellektueller beobachtet wurde, nutze er 1937 den Kölner Karnevalstrubel zur Emigration in die Schweiz. Dort wurde König an der Universität Zürich 1938 im Fach Soziologe habilitiert.[2] Professor in Köln: Nach schwierigen Zeiten als Privatdozent und außerordentlicher Professor in Zürich wurde René König 1949 als ordentlicher Professor für Soziologie an die Wirtschafts- und Sozialwissenschaftliche Fakultät der Universität zu Köln berufen. Trotz Rufen an andere Hochschulen blieb er dort bis zu seiner Emeritierung 1974. Gastprofessuren führten ihn in die USA, und an Hochschulen in Europa, Afrika sowie im Rahmen der Aufbauhilfe an die Universität Kabul in Afghanistan. Leistungen: Der fruchtbare, durchaus auch kampflustige Autor und vorzügliche akademische Redner König beschäftigte sich intensiv mit der deutschen Nachkriegsgesellschaft und setzte sich nachhaltig für die empirische Sozialforschung in Deutschland ein. Dabei grenzte er sich von einer sozialphilosophisch geprägten dialektischen Soziologie ab, wie sie Theodor W. Adorno und die Frankfurter Schule betrieben. Er wandte sich angesichts seiner Erfahrung mit jugendbewegten Nazis an der Universität auch scharf gegen jede Anhimmelung von Gemeinschaft'. Diese Haltung Königs wurde im Schweizer Exil in den 1940er Jahren bestärkt. . René König machte die französischen Klassiker der Soziologie (Émile Durkheim, Marcel Mauss, Maurice Halbwachs u. a.) in Deutschland wieder bekannt und veröffentlichte und edierte zudem viele Untersuchungen auf den Gebieten der Gemeinde-, Familien-, Kriminal-, Entwicklungs- und Industriesoziologie, namentlich aber auch Methodisches im Bereich der empirischen Sozialforschung. René König war auch als radikal-liberaler Publizist, mehrsprachig-hochgebildeter Essayist, homme de lettres mit Esprit und Übersetzer tätig, etwa des sizilianischen Romanciers Giovanni Verga, zu dessen 1880 erschienenem Roman Die Malavoglia er ein anregendes literar-soziologisches Nachwort zur kulturellen Bedeutung von Fremdheit, Marginalität, Auswanderung und Rückkehr (Re/Migration) veröffentlichte. .
