Patrick Zurth untersucht den negatorischen Anspruch aus rechtshistorischer, rechtsökonomischer und rechtsdogmatischer Perspektive und entwickelt dabei ein neues Verständnis des 'Störers'. Dieses Merkmal bildet den zentralen Tatbestand des1004 BGB und tritt auch außerhalb dieser Norm im Zivilrecht in Erscheinung, insbesondere bei der sog. Störerhaftung im Immaterialgüter- und Persönlichkeitsrecht. Ziel der Arbeit ist es, über verschiedene Teilbereiche des Privatrechts hinweg einen einheitlichen Störerbegriff deduktiv herzuleiten.
