La función especial del Derecho se ejercita separando acciones posibles de otras que también lo son; el simple hecho, o bien la posibilidad de orden físico, por ser común a los términos de la antítesis, no constituye un elemento distintivo o diferencial, sobre el cual pueda fundarse una proposición jurídica cualquiera. Para que se realice un juicio sobre el derecho debe darse un principio de orden racional, no de adecuación, sino de graduación de los hechos.
