In-8° (cm. 20), genuina legatura in cartonato d'attesa, pp. [16] 139 in ottimo stato e in barbe, con 1 tavola in rame fuori testo incisa da Gaetano Le Poer (stemma araldico); piccola gora al margine superiore di qualche carta. Edizione originale assai rara delle osservazioni del Risi, prima opera di un tecnico del diritto che possa essere salutata come pienamente beccariana. Illustre illuminista milanese, magistrato di carriera, Risi è padre della strategia discorsiva garantistica e della teoria degli indizi, sorta per l'appunto con la cessazione dei sistemi di prova legale basati sulla confessione e sulla tortura [S. Solimano, Paolo Risi e il processo penale, in Studi di storia del diritto, 3, Milano, Giuffrè, 2001, pp. 419-519]. Qui, a due anni dal Dei delitti e delle pene, sostiene la presunzione di non colpevolezza dell'imputato; il diritto alla difesa, il contraddittorio e la pubblicità; laterzietà del giudice; infine i limiti della pena di morte (che lo porteranno poi all'abolizionismo). This volume contains two works that illustrate the early reception of Enlightenment ideas on criminology in Germany. Quistorp, a professor of law at the University or Rostock and later Rector of the University of Butzow, was an authority on criminal law. Grundsatze, his principal work, is a general treatise. Likely influenced by Beccaria's Dei Delitti e Delle Pene (1764), it advocated a reduction of capital offenses and the abolition of torture to obtain confessions. It went through several editions and issues, the last one in 1828, and was one of the sources of the influential German Penal Code of 1871. Risi was a judge in Milan and one of Beccaria's associates. The work of an anonymous translator, Abhandlung is a translation of Risi's Animadversiones ad Criminalem Jurisprudentiam (1766), a practical treatise on criminal procedure that incorporated principles drawn from Dei Delitti e Delle Pene.
