The evaluation of the existing privatisation models shows that the constitutional requirements are only fully met in a few cases.; Die Arbeit untersucht die verfassungsrechtlichen Vorgaben für Privatisierungen im Justiz- und Maßregelvollzug und bewertet die in den Bundesländern realisierten Privatisierungsmodelle. Einem einleitenden Teil folgt zunächst eine Darstellung des Realbefunds der existierenden Privatisierungsvarianten. Sodann werden generell die verfassungsrechtlichen Anforderungen und Grenzen für Privatisierungen untersucht, die sich insb. aus Art. 33 Abs. 4 GG, dem Demokratieprinzip sowie dem Gewaltmonopol des Staates ableiten. Anschließend werden diese Anforderungen mit Blick auf Privatisierungen im Justiz- und Maßregelvollzug konkretisiert, ehe die existierenden Modelle an diesen Maßstäben gemessen und bewertet werden. Es wird dabei deutlich, dass die verfassungsrechtlichen Anforderungen nur vereinzelt vollumfänglich erfüllt werden, wohingegen viele der untersuchten Modelle defizitär und damit verfassungswidrig sind.
