As-Suyūṭī followed Ibn Ḥajar's judgement and said, It is absolutely correct to say that the Muwaṭṭa' is sound (ṣaḥīḥ) without exception. Al-Bukhārī and Muslim transmitted most of its ḥadīths and included them in their Ṣaḥīḥ collections. Die Muwatta enthält insgesamt knapp 1800 Überlieferungen und setzt sich aus einer Sammlung von Hadithen (Berichten von Aussagen und Taten des Propheten des Islam Muhammad, Allahs Segen und Frieden auf ihm); Rechtsgutachten und Entscheidungen der Prophetengefährten; Aussagen und Rechtsgutachten der darauffolgenden Generation (die Schülergeneration der Prophetengefährten, welche persönlich auch einige der Prophetengefährten gesehen haben) und Rechtsgutachten des Imam Malik sowie späterer Gelehrter zusammen. Das Werk kann als die erste Formulierung des islamischen Rechts bezeichnet werden, welche auf der Herangehensweise des malikitischen Rechtsverständnis beruht. Imam Malik korrigierte und sortierte sein Werk über Jahre hinweg, daher gibt es mehrere Überlieferungen der Muwatta, die sich zum Teil geringfügig im Aufbau unterscheiden. Die Muwatta wurde von seinen unmittelbaren Schülern rezensiert und weitergegeben. Am bekanntesten ist die Rezension von Yahya Ibn Yahya al-Laithi (gest. 233 n. H. in Cordoba), die auch mehrfach nachgedruckt worden ist. Für die Wichtigkeit dieser Rezension spricht die Tatsache, dass sie in der malikitischen Rechtsgelehrsamkeit am häufigsten kommentiert wurde. Die Muwatta umfasst insgesamt 61 Kapitel ('Bücher') und teilt sich in die übliche Gliederung islamischer Rechtswerke auf. Die vorliegende Übersetzung ist das vollständige 18. Kapitel aus dem vorher erwähnten Gesamtwerk und beruft sich auf die bekannteste Rezension von Yahya Ibn Yahya al-Laithi, dem zuvor erwähnten Schüler von Imam Malik. Die arabischen Originalzitate wurden den Übersetzungen vorangestellt. Ebenso wurden zum besseren Verständnis in den Fußnoten Kommentare und Erläuterungen hinzugefügt.…
