Sonst gut und sauber. - Principles of Equity was the most important work on law by one of the leading figures of the Scottish Enlightenment, Henry Home, Lord Kames (16961782). Friend to David Hume, Adam Smith, John Millar, and Thomas Reid, among many other leading lights of the time, Kames wrote on many subjects, including philosophy, history, criticism, and even husbandry; but he considered Principles of Equity to be "my chief performance," and said that he had "never labored harder upon any subject." Before publishing the first edition of Principles of Equity in 1760, Kames had already completed a philosophical treatise, Principles of Morality and Natural Religion (1758), which set out his theory of the moral sense. He had also played a pioneering role as a law reporter in Scotland, and had been appointed as a judge in the Court of Session in 1752. The philosophical and legal knowledge he had cultivated in these earlier works was brought together in Principles of Equity, which was a philosophical treatise explaining the nature of legal development. In Kames's view, the moral sense became more refined as societies developed, and with this development, an increasing number of acts of benevolence came to be recognized by the law as duties. When "by ripeness of discernment and delicacy of sentiment, many duties, formerly neglected, are found to be binding in conscience," they came under the jurisdiction of a court of equity. Equity consequently played a crucial role as a midwife for legal development: "what originally is a rule in equity loses its character when it is fully established in practice; and then it is considered as common law." In Principles of Equity, Kames sought to explore this process by examining the law of property, torts, contracts and bankruptcy, drawing his examples not only from the Scots law he knew so intimately, but also from Roman law and English common law. Having read Principles of Equity "with great satisfaction," the Chief Justice of the English Court of King's Bench, Lord Mansfield, wrote to Kames, "You have taught men to trace law to its noble sources: philosophy & history." Michael Lobban is Professor of Legal History at the London School of Economics and Political Science. He is the author of The Common Law and English Jurisprudence, 17601850 (1991), White Mans Justice: South African Political Trials in the Black Consciousness Era (1996), and A History of the Philosophy of Law in the Common-Law World, 1600-1900 (2007). Sonst gut und sauber. - Introduction: Lord Kames's Elements of Criticism, although it is essentially a compendium of mid-eighteenth century British ideas and attitudes on literature, human nature, and morals, proved quite durable. Over forty editions have appeared, including abridgments and translations, and it was still being used as a rhetoric text in American schools near the close of the following century. This long career seems all the more notable because the Elements is such a huge and sprawling work, yet the sprawl is largely illusory, for the book is so carefully organized that any discussion of it, such as this one, falls more or less inevitably into the logical order which the author himself followed. Ernst Cassirer has remarked that critics tend to focus their attention upon either the creative act, the literary artifact, or the effect of the work upon the reader. In actual practice, though, few critics concern themselves so single-mindedly with just one of these categories as Kames does, in his case, the last. He sets out to exhibit the fundamental principles of the fine arts by drawing them "from human nature, the true source of criticism". In the first two chapters he outlines his psychological system; then, in the succeeding fourteen chapters Kames discusses at length those aspects of the psyche which function specifically in aesthetic experience, and he derives a number of critical principles. These first two sections are analytic and empirical in method; literature is cited chiefly to illustrate the workings of the mind. The balance of the treatise is synthetic and involves laying down "practical rules for the fine arts, derived from principles previously established." Most of this half consists of an elaborate rhetorical system, the last few chapters making up - if we overlook the digression into architecture and gardening - Kames's poetics, in which a number of received critical dicta are measured against his principles and discarded if they do not conform. Despite Kames's obvious relish for reasoning things out, it is an affective psychology which he describes in the first two chapters of the Elements-, man's aesthetic experience, like his moral, life, is fundamentally emotional. Furthermore, the psychology is associationist, in the tradition of Hobbes, Locke, and Hume: the mental life consists of a train of ideas related to each other by principles of contiguity, resemblance, cause and effect, and also regulated, Kames adds, by a sense of order. He softens the determinism which characterizes his earlier writings by granting that "this order . may be varied by will, but still within the limits of related objects." This side of madness, we cannot finally escape those basic principles which relate one idea to another, and also we are thrall to the forward momentum of the train of ideas, which makes us, willy nilly, dynamic creatures, uneasy with the static, delighting in motion. The first book describes progress in such areas as laws regarding property, commerce, the arts, manners, the treatment of women, and luxury. The second book has a more political focus, treating the development of states and their governments, along with a detailed consideration of taxation. The subject of the third book is the progress of the sciences. Here Kames describes the development of reasoning and logic, the principles and history of morality, and the progress of theology and religion. In a letter to a friend, Kames describes Sketches as "a general history of the human race in its gradual progress toward maturity." Nevertheless, like his near-contemporary Adam Ferguson, Kames worries about the debilitating effects of the modern age's preoccupation with wealth and luxury, and his belief in the reality of progress is tempered by pessimism as to its continuation in the future. -- The Liberty Fund edition is based on the posthumous third edition of 1788 and is the first modern edition available.
