Da… die EG keine Sachkompetenz für das geistige Eigentum besitzt, ist die Verteilung der Kompetenzen durch ein Nebeneinander von verschiedenen Kompetenzen der EG und ihrer Mitgliedstaaten gekennzeichnet. Die Verfasserin legt dar, daß die Verteilung der Kompetenzen im Hinblick auf die möglichst weitgehende Angleichung der Rechte des geistigen Eigentums durch sekundäres Gemeinschaftsrecht, nicht aber durch völkerrechtliche Verträge, sachgerecht ist, und schlägt vor, die ausschließliche Kompetenz der EG für die gemeinsame Handelspolitik auf das geistige Eigentum als solches zu erstrecken.Auf der Grundlage der dargestellten Verteilung der Kompetenzen arbeitet die Autorin am Beispiel der EG und ausgewählter Mitgliedstaaten rechtsvergleichend heraus, daß die völkerrechtlichen Verträge auf dem Gebiet des geistigen Eigentums nur dann uneinheitlich durchgesetzt werden, wenn sie, wie im Fall des TRIPs, einen unmittelbaren Bezug zum Handel aufweisen.Karen Kaiser kommt zu dem Schluß, daß die Aufnahme des geistigen Eigentums als solches in die ausschließliche Kompetenz für die gemeinsame Handelspolitik die Kohärenz des wirtschafts- und außenpolitischen Handelns der EG insbesondere dadurch stärken würde, daß die rechtspolitische Entscheidung gegen die unmittelbare Anwendbarkeit alle Bestimmungen des TRIPs-Übereinkommens betreffen würde.
