I. 2. Under the fecond head, were thofe laws, which puniihed the Engliih communi cants with the church of Rome for not con fonm'ng to the giablflhed church. Thefe are generally. Called the Statutes of Recnfancy. It ihould be obferved, that, abfence from church, alone; and unaccompanied by any other act, eonftitutes recufancy, in the true fenfe of that word. Till the flatute of the 35 Eliz. Chap. 2. All nonconformifis were confidered as recu fflfltfiy and were all equally fubjeét to the pe' nalties of recufancy: that fiatu'te was the firfi penal fiatute made againit popilb recufants, by that name, and as °difiinguifhed from other recufan ts. From that fiatute arofe the difiinélion between protefiant and popiih recufants; the' former were fubjeét to fuch flatutes of recufancy, as preceded that of the 3 sth of queen Elizabeth, and to fome fiatutea againfi: recufancy, made fubfequently to that time; but they were relieved from them all.
