Inhaltsangabe: Boilerplate, the fine print of standard contracts, is more prevalent than ever in commercial trade and in electronic commerce. But what is in it, beyond legal technicalities? Why is it so hard to read and why is it often so one-sided? Who writes it, who reads it, and what effect does it have? The studies in this volume question whether boilerplate is true contract. Does it resemble a statute? Is it a species of property? Should we think of it as a feature of the product we buy? Does competition improve boilerplate? Looking at the empirical reality in which various boilerplates operate, leading private law experts reveal subtle and previously unrecognized ways in which boilerplate clauses encourage information flow, but also reduce it; how new boilerplate terms are produced, and how innovation in boilerplate is stifled; how negotiation happens in the shadow of boilerplate, and how it is subdued. They offer a new explanation as to why boilerplate is often so one-sided. With emphasis on empiricism and economic thinking, this volume provides a more nuanced understanding of the 'DNA' of market contracts, the boilerplate terms.

Inhaltsangabe: This book explores the boilerplate, or the fine print of mass-distributed contracts. Looking at what is written in them and what is similar between certain mass-marketed fine print, boilerplate is broken down and examined. Is it true contract? Who reads them? Who proofs the boilerplate? Why is it so hidden? This book explores boilerplate as part of contract law.

Anbieterinformationen: We have been selling academic and scholarly books in Cambridge since 1996. Today we occupy an old warehouse on Coldhams Road, adjacent to the railway tracks leading to Ely, not too far from the airport. The site is called Restwell House. We are an internet bookshop, but visitors are very welcome. Some drop off a few boxes of unwanted books, some pick up a book to save on the postage, some just drop by to get to know us, or want to take advantage of the many bargains on our wooden shelves bookshop, which is distinct from the internet stock offered on the web. Our mission has always been to find new homes for the books we are looking after. If we cannot sell them online, we offer them at very low prices to our visitors. We try to give you a serious and dedicated service which is focussed on the individuality of each single book: its condition, its origin, sometimes even its smell. You come to us for real books, not just instances of ISBNs.
