That thereupon the said D then and there took upon himself the administration Of said estate and from thence hitherto has been and still is such administrator.

But the plaintiff avers that the said defendant, D, has not faithfully performed the acts required of him, or his duties as such administrator, according to the terms of the said condi tions of the said writing Obligatory, but has wholly failed and refused so to do, to the injury of said J, R, S, B and G.
