The Moohummudan Law of Sale, According to the Huneefeea Code From the Futawa Alumgeeree, a Digest of the Whole Law, Prepared by Command of the Emperor Aurungzebe Alumgeer

Paperback. Zustand: New. Language: English. About The Book: In this book, the author delves into "The Moohummudan Law of Sale" as per the Huneefeea Code, which is derived from the Futawa Alumgeeree, a comprehensive legal compilation commissioned by Emperor Aurungzebe Alumgeer. Within Islamic law, the concept of "sale" takes on a broader scope than its traditional interpretation. It encompasses not just the exchange of goods for money but also property-for-property exchanges, including barter and loans where the borrowed items are meant for consumption and eventual replacement. This form of exchange, termed "kurz" in Islamic law, receives detailed attention in the first section of the treatise. Although many legal systems often blur the lines between barter and sale, Islamic law places a strong emphasis on scrutinizing both sides of the contractual agreement. This scrutiny centers on defining the concept of "price" and enforcing regulations to prevent unfair advantage in various types of exchanges. In this context, "property" denotes tangible or physical assets that can be possessed and secured. About The Author: Neil B. E. Baillie (1799-1883) was a renowned scholar in Islamic law, notably in the context of British courts in India. His works include the "Digest of Muslim Law for British Courts," a valuable resource. He also explored the Sultan of the Turks' claim to the Caliph title in "Is the Sultan of the Turks the Caliph of the Muslims." Additionally, Baillie examined land taxation in India from an Islamic law perspective and contributed significantly to reports on Indian territories. His enduring legacy impacts scholars, historians, and legal professionals studying Islamic law and British colonial India.
