Die von Hans Kelsen im Jahre 1934 vorgelegte "Reine Rechtslehre" gehört zu den rechtstheoretischen Schlüsselschriften des 20. Jahrhunderts. In ihr entwickelt Kelsen erstmals systematisch seine einerseits das Recht von der Moral, andererseits die Norm vom Faktum konsequent scheidende, ideologiekritische Rechtstheorie.Die 1960 erschienene Zweitauflage der "Reine(n) Rechtslehre" stellt gleichermaßen Höhepunkt und Abschluss der sogenannten "Klassischen Phase" im rechtstheoretischen Werk Hans Kelsens dar. Mit Herbert Harts "Concept of Law" (1961) ist sie das wirkmächtigste Werk des modernen rechtstheoretischen Diskurses.Mit seinem Werk "Allgemeine Staatslehre" reiht sich Kelsen in eine spezifisch deutschsprachige Tradition ein - und doch begründet er mit ihr etwas grundstürzend Neues. Denn das Werk markiert nicht nur die Auftaktschrift für den sogenannten Weimarer Richtungs- und Methodenstreit.
