This book covers both the hard and soft issues regarding contract management. As well as looking at for example how to hold an inaugural meeting or deal with a contractual claim, we also discuss the nature of the relationship with the contractor, looking at both adversarial and collaborative models as well as measures you might take to motivate the contractor. This second edition contains many examples of good and bad practices in the context of contract management, as well as additional chapters relating to Developing Scopes of Work, Leasing Contracts and International Contracting. The book is written from the standpoint of getting it right first time; we view good contract management as a positive adding-value process. Nevertheless, the book does not shy away from the fact that things do and will go wrong, and therefore there are also chapters on dispute resolution and legal issues that might affect the individual managing the contract. It is clear from reports from IACCM, government bodies and private sector research that there is scope for substantial savings through good contract management. It is a professional discipline that should be carried out by professionals, which should lead to better contractor performance.
Biografía del autor:
Alan Oxenbury BA; MCIPS; Cert. (NEBOSH) Alan is a procurement trainer and consultant. After graduating from Exeter University in 1977 with a BA in Economics, Alan began his career at a County Council as a Purchasing Officer for hydrocarbon products and highways materials. Alan has also worked for the Post Office as a Senior Purchasing Officer for postal sorting office equipment and furniture, before moving to the electricity sector working on the several power station construction projects. Alan then became a Procurement Policy and Manager for a nuclear decommissioning company, where he was a source of expertise on all matters of procurement policy, procedure, guidance, practice, training and contract documentation and terms and conditions. Alan now regularly delivers CIPS training courses, both on their public programme for subjects as Introduction to Purchasing and Contract Law well as for the professional qualifications at levels 4, 5 and 6. Alan also delivers training for UK public and private sector organisations covering subjects such as Value for Money, Risk Management and EU Procurement Legislation. Alan is currently a Senior Examiner for the CIPS module "Developing Contracts in Purchasing and Supply" and has also contributed several articles for the student page of "Supply Management" (CIPS Journal). R J Carter MA FRSA MCIPS MCMI Cert Ed Ray is the Director of DPSS Consultants (Developing People Serving the Supply Chain), which is an international training and development consultancy made up of 20 specialist consultants. He began his management career in the public sector and thereafter for a large food manufacturer in the UK. He graduated from University with a Masters Degree in Management Studies. His first book relating to supply chain management entitled Integrated Materials Management, was published in 1982 and has become a recommended text for a number of courses, including the Chartered Institute of Purchasing and Supply. This was followed by Stores and Physical Distribution, published by Liverpool Academic Press. He is currently working on his new titles, Understanding Supply Chains with Professor David Jessop and Practical Procurement with Steve Kirby due for publication by Cambridge Academic Publishing. Ray has had numerous articles and papers published in journals such as Supply Management and the Centre for Advanced Procurement's Praxis publication. Ray is also Chairman of the Procurement Best Practice Forum, which is made up of many large blue-chip organisations, the purpose of which is to identify and disseminate supply chain management best practices. Ray's now famous `7Cs' of supplier evaluation model, first published in 1995, has now become an accepted model for the evaluation of supplies and contractors and has been adopted by many organisations. It is also part of the CIPS level 4 syllabuses. Until 1991 Ray was Principal Lecturer in Supply Chain Management at the Business School, University of North London. In recent years, he has undertaken training and consultancy assignments for organisations such as Shell IT, Lucas Engineering and Systems, the Chartered Institute of Purchasing and Supply, BRC, Nederlandse Aardolie Maatschappij.B.V, Abu Dhabi Company for Onshore Oil Operations (ZADCO), NDC, UK Intervention Board, Ericsson, British Aerospace, Marconi, BBC, Magnox, Ordnance Survey, Chevron, Caspian Pipeline Consortium, Tengzichevroil Company, Medway Council, Coca-Cola and Shell International BV. Ray has worked in many locations, including the Far East, the Middle East, South America, Europe and Africa. The majority of these events have been related to strategic issues in relation to supply chain management, procurement and contracting. S K Kirby BA (Hons), MCIPS, MCMI, Dip. M, Cert. Ed Steve is a freelance Procurement trainer and consultant. His early career was spent working in a purchasing capacity for a number of companies in the West Midlands, all involved in the heavy engineering sector. From 1979 until 2002 he was a senior lecturer at Sandwell College in the West Midlands and specialised in teaching all levels of CIPS provision from International Certificate up to the (equivalent) current Level 6. His particular specialisation was `pure' purchasing modules with Stores and Inventory subjects as a secondary specialisation. From 1990 onwards, he was programme manager of CIPS courses aimed both at part-time and full-time students, the latter courses providing Steve with much experience of students from overseas, particularly from Arab countries and sub-Saharan Africa. Steve is currently a visiting lecturer at University of West London (formerly Thames Valley University), teaching CIPS programmes at both levels 4 and 5. He is Senior Assessor for the CIPS International Advanced Certificate module of Preparing and Managing Contracts. Steve is Senior Purchasing Tutor for Cheltenham Tutorial College. In this last capacity, he gives distance learning support to students at all levels of CIPS provision and has written study materials for the college. In recent years, Steve has had articles published on the `Students' page of `Supply Management' (CIPS journal). Steve has also provided supply chain training in the private sector for Consignia (now Royal Mail) and has carried out CIPS-related training, on behalf of DPSS, for Shell Expro Ltd. in both Nigeria and Aberdeen. He has also provided CILT training for BMMI Ltd. in Bahrain and bespoke Procurement training, carried out in French, for BP in Algeria. Geoff Kontzle, APMP FLD DTLLS MCIM CILT Geoff is Managing Director of K3 Consulting & Training Services Ltd a specialist training organisation providing wide variety of training and coaching services to businesses in terms of start up, supply chain, negotiation skills and a range of management & leadership development areas too. He is also the Chartered Insitute of Procurement & Supply (CIPS) course Director for DPSS Consultants at their (CIPS) Centre of Excellence and supports procurement training in the UK and internationally too. Geoff began his career in the UK Financial services sector working with Barclays Plc with a main focus toward Asset Finance and Leasing. His career developed into Procurement whilst managing for Capita Group Plc a specialist financial services outsourced procurement service in supporting tender and bid management including contract development and analysis reporting for recommendation to public sector clients. Following that position Geoff returned to the banking fold as Head of Public Sector for Alliance & Leicester Commercial Bank. Geoff is a qualified teacher and gained his degree at University of Winchester, he has written extensively a number of journals for Euromoney and has had his work published from 2000 to to date in their World Leasing annual publications. He has also spoken at a number of International Conferences in Belgium and Italy and in the UK discussing Asset Finance, Leasing and Contract issues. He has been a previous Chair of the Finance & Leasing Associations (FLA) NHS/ Local Government Forum and initiated the development and conclusion of model form contract for use between leasing leassors and the NHS. In recent years, he has undertaken training and consultancy assignments for organisations such as Centrica (British Gas), Capita, UK Central Government, HMRC, Shell, Chevron, QinetiQ, NHS, Sainsbury's, Finance & Leasing Association, Transport for London, Lambeth, Westminster, Redbridge, Havering and Havant Councils. Geoff has worked in many locations, including the Far East, the Middle East, Europe and Africa.
