Yet SO thoroughly familiar are most Of the aspects Of the railroad problem that their extended treat ment must be entirely unnecessary. Accordingly the author has confined himself, in the first chapter, to a por trayal in barest outline Of the historical back ground Of the problem and Of its basis in economic theory. Only those matters which bear a very important relation to the particular question discussed in the later chapters, are subjected to comment Of any length. Indeed the whole purpose Of the preliminary Chapter is to cast the light Of history and Of theory upon the problem Of judicial review, in order to discover its Significance, and to determine the point Of view from which it Should be regarded.
